Preliminary Remarks, Note

These redeeming conditions apply whenever, with reference to these redeeming conditions, vouchers are announced or issued to you (“you” also being the “User” in the meaning of these redemption terms). These redeeming conditions apply in conjunction with any special conditions for the respective promotion campaign or the respective occasion on which vouchers are issued. The specific conditions will be announced to you as part of the voucher announcement or issuance of the voucher and would particularly concern information on the specific voucher value, the service type, the validity period and certain conditions for the receipt of the voucher (e.g. issuance only to "first time pay by app" users, in the context of referral programs, competitions).

Note: For the use of the/FreeNow-App including its "Pay by App" feature (hereinafter “the App”), the local operator’s terms and conditions for passengers apply in the version currently valid in your selected country. 

In the case of passenger transportation, neither the Issuer of the vouchers nor its affiliated operating companies in the participating countries are parties to the passenger transport contract between the passenger and the transportation company as the Issuer or its affiliates, respectively, only act as an intermediary of such contracts. 

In case of applicable tariff regulations, the Transport Operator will always receive the full fare according to the applicable tariff of the regional regulation.

1. Issuer 

The Issuer of the vouchers is mytaxi Italia srl (hereinafter referred to as "Issuer").

2. Content of the voucher, validity, regional scope

(1) Within the scope of these redeeming conditions, the Issuer gives each of the App users, who are eligible according to section 3. below, the opportunity to redeem the respective voucher for the Covered Service Type (i) only within the specified validity period  or in the context of the respective promotion campaign, (ii) exclusively in case of cashless payment by App and (iii) within the territorial scope defined in section 2.(3) below.

(2) The redemption is limited to the maximum amount of the stipulated voucher value. Even in the case of a voucher issued in the form of a percentage share in the costs of the ride, the voucher value may be limited to a maximum amount, the amount of which will be announced to you when the respective voucher is issued. If the costs incurred for a ride exceed the value of your respective voucher, the difference must be paid by you. The voucher will not cover the fees that FREE NOW may charge from time to time. 

(3) A voucher may also be limited to a maximum number of uses (hereinafter referred to as the “Redemption Limit”), previously decided by the Issuer. Once the Redemption Limit is reached, the voucher will be automatically deactivated. In case the User had deposited the voucher, but had not redeemed it before the Redemption Limit was reached, they will not be able to use the voucher. The User will receive a message informing them that the voucher redemption limit has been reached.
 

(4) The redemption is possible within the announced validity period and only in selected areas in which the FREE NOW intermediation service is available.

The vouchers under these redeeming conditions will be issued as an individual voucher code per each selected country. The individual voucher code is redeemable only in that designated country.

In the case of passenger transportation via taxi, a voucher may only be redeemed for a taxi ride that starts and ends in one of the cities within the Territorial Scope mentioned above, whereby the area of application of the taxi / taxi tariff regulations valid for the respective city must not be left during the taxi ride.

3. Eligibility

(1) If a voucher is issued for the first payment by App, it can only be redeemed in case where at the time of redeeming the voucher, the User has never paid for a ride using Pay by App. If on the first Pay by App trip, the User has not redeemed the voucher, the voucher expires, and the User will not be able to take advantage of the voucher for the first payment by App for any later Pay by App trip.  

(2) The redemption of any voucher issued under these redeeming conditions requires that the User has previously downloaded the App from the Appstore available on his smartphone (Android or iOS), installed it on his smartphone, has registered for free with the App by providing the information required for registration purposes (especially first and last name, Phone number, valid email address, secure password) and thereby accepting the terms and conditions for passengers applicable in the respective country. The User must then register an available payment method for Pay by App purposes depending on the country of use (e.g. credit or debit card, PayPal, Apple Pay, Google Pay). 

(3) Any natural person of the age of 18 or older is entitled to participate and redeem the voucher. Our business customers, our Business Account customers and their respective employees who have been given the authorization to use the App for the payment of business trips are not eligible to participate in the respective voucher promotion and may particularly not redeem the voucher upon paying a business trip via the App.

(4) The redemption is limited to the maximum amount of the stipulated voucher value. Even in case of a voucher issued in the form of a percentage share in the costs of the ride, the voucher value may be limited to a maximum amount, the amount of which will be announced to you when the respective voucher is issued. If the costs incurred for a ride exceed the value of your respective voucher, the difference must be paid by you. 

(5) Redemption is only permitted once within the stipulated validity period. A redemption past the validity period is excluded.

(6) The voucher and its respective voucher value expire once it has been used. Reusing your voucher is not possible. An expired voucher lapses without replacement. A cash payout of vouchers or of any voucher credit is excluded.

(7) The Issuer, or the affiliated operating company in the country where the voucher is redeemed, may in its absolute discretion block and/or delete the user’s account if it has reasonable grounds for suspecting that the User has used a Voucher in breach of these redeeming conditions, unlawfully, fraudulently or in bad faith. The Issuer, or the affiliated operating company in the country where the voucher is redeemed, will have the right to ask the User for reimbursement of any value or service that has been gained fraudulently.

4. Redemption

(1) As soon as you have registered as a User of the App and have activated the Pay by App feature (see above section 3 (2) for details), in order to redeem the voucher, you must deposit the voucher which will be announced to you in the form of a corresponding voucher code in the App. 

(2) If within the validity period and Territorial Scope of your voucher you (i) order a ride with the App, complete the tour and pay by App or (ii) in case of a so-called hop on tour using a taxi, in which case the taxi was not ordered with the App, you complete the tour and pay by App, no payment is required up to the voucher value shown on the voucher that you have previously deposited. If the bill exceeds the voucher value, the difference must be paid by you via the App.

(3) If you use a voucher in accordance with these redeeming conditions for passenger transportation via taxi, the gross transport fare will continue to be based on the valid taxi fare of the local taxi regulations applicable in the respective area of validity. The taxi operator will receive the full taxi fare (plus any tip you have chosen to give and plus applicable VAT). When using a valid voucher for passenger transportation via taxi, the Issuer will take over from your taxi bill the amount resulting from the value of the voucher.

(4) Vouchers cannot be combined with other offers, subsidies, vouchers or discounts. The vouchers have no cash value, are non-transferable and can only be redeemed once. The voucher can only be redeemed by entering the respective voucher code. There is no substitute for lost or stolen vouchers. The voucher cannot be sold, resold or redeemed for cash.

5. Miscellaneous 

(1) Should individual provisions of these redeeming conditions be or become invalid, the validity of the remaining conditions shall remain unaffected. The invalid provision shall be replaced by a provision that best approximates the intent of the invalid provision. 

(2) These redeeming conditions may be amended by the Issuer, provided that the present conditions contain gaps (additions) or where subsequent factual or legal disruptions arise that may materially impair or render impossible the purpose of the respective promotional campaign under these redeeming conditions.

(3) These redeeming conditions are subject to the laws of the Italian Republic. If you are a consumer and have a habitual residence in the EU, you additionally enjoy the protection afforded by mandatory provisions of the law of your country of residence.

Considerazioni preliminari, Nota

Le presenti condizioni di riscatto si applicano ogni volta che, con riferimento alle stesse, vengono notificati o rilasciati buoni all'Utente ("Tu" in qualità di "Utente" ai sensi delle presenti condizioni di riscatto). Le presenti condizioni di riscatto si applicano in combinazione con le eventuali condizioni speciali della relativa campagna promozionale o dell'occasione in cui vengono emessi i buoni. Le condizioni specifiche ti saranno comunicate nell'ambito dell'annuncio o dell'emissione del buono e riguarderanno in particolare il valore specifico del buono, il tipo di servizio, il periodo di validità e alcune condizioni per la ricezione del buono (ad es. emissione solo per gli utenti che usano il servizio Pay by App per la prima volta ("First Time Pay by App"), nell'ambito di programmi referral, buoni omaggio, concorsi, iniziative di raccolta punti).

Nota: Per l'uso dell'app FREE NOW, inclusa la funzione "Pay by App" (di seguito "l'App"), si applicano i termini e le condizioni per i passeggeri dell'operatore locale, nella versione attualmente valida nel paese selezionato dall'Utente.

In caso di trasporto di passeggeri, né l'Emittente dei buoni né le società operative affiliate nei paesi partecipanti sono parti contraenti del contratto di trasporto di passeggeri tra il passeggero e la società di trasporto, poiché l'Emittente o le sue affiliate, rispettivamente, agiscono solo come intermediari di tali contratti.

In caso di regolamenti tariffari applicabili, la Società di trasporto riceverà sempre la tariffa completa in base alla tariffa applicabile del regolamento regionale.

1. Emittente

L'Emittente dei buoni è mytaxi Italia srl (di seguito denominato "Emittente").

2. Contenuto del buono, validità, ambito regionale

(1) Nell'ambito delle presenti condizioni di riscatto, l'Emittente offre a ciascuno degli utenti dell'App, idonei ai sensi della sezione 3 di seguito, l'opportunità di riscattare il rispettivo buono per il tipo di servizio coperto (i)solo entro il periodo di validità indicato o nell'ambito della rispettiva promozione, (ii) esclusivamente in caso di pagamento senza contanti tramite App e (iii) nell'ambito di applicazione territoriale definito nella sezione 2.(3) di seguito.

(2) L’utilizzo del codice promozionale è limitato ad un valore massimo. Anche nel caso di un voucher con sconto in percentuale sulla corsa, il valore del voucher potrebbe essere limitato ad un ammontare massimo. Il suo valore ti sarà comunicato ogni volta che il voucher verrà emesso. Se il costo totale della corsa eccede il valore del voucher, dovrai pagare la differenza. Il voucher non copre il costo del servizio di intermediazione che FREE NOW può addebitarti ad ogni corsa completata.

(3) Il valore di un codice promozionale potrebbe essere limitato ad un numero massimo di utilizzi (in seguito denominato “Limite massimo di utilizzi”), precedentemente definito dall’Emittente. Una volta raggiunto il limite massimo di utilizzi, il voucher sarà disattivato in automatico. Nel caso in cui l’Utente abbia già depositato il voucher in App, ma non lo abbia ancora utilizzato, una volta raggiunto il numero massimo di utilizzi stabilito da FREE NOW, il voucher non sarà più utilizzabile.

(4) Il riscatto è possibile entro il periodo di validità annunciato e solo in aree selezionate in cui è disponibile il servizio di intermediazione FREE NOW.

Ai sensi delle presenti condizioni di riscatto, i buoni verranno emessi come codice buono individuale per ciascun paese selezionato. Il codice buono individuale può essere riscattato solo nel paese designato.

In caso di trasporto di passeggeri tramite taxi, un buono può essere riscattato solo per i viaggi in taxi che iniziano e terminano in una delle città all'interno dell'ambito territoriale sopra menzionato, per cui, durante la corsa in taxi, occorre rimanere entro l'area di applicazione del regolamento relativo al taxi/tariffe taxi valide per la rispettiva città.

3. Idoneità

(1) Se un buono viene emesso per il primo pagamento tramite App, esso può essere riscattato solo nel caso in cui, al momento del riscatto, l'Utente non abbia mai pagato una corsa utilizzando la funzione Pay by App. Se in occasione del primo viaggio pagato con Pay by App l'Utente non ha riscattato il buono, quest'ultimo scade e l'Utente non potrà usufruirne per il primo pagamento tramite app (per qualsiasi viaggio successivo pagato tramite Pay by App). 

(2) Il riscatto di qualsiasi buono emesso ai sensi delle presenti condizioni di riscatto richiede che l'Utente abbia precedentemente scaricato l'App dall'App store disponibile sul suo smartphone (Android o iOS), l'abbia installata sul suo smartphone, si sia registrato gratuitamente con l'App fornendo le informazioni necessarie per la registrazione (in particolare nome e cognome, numero di telefono, indirizzo e-mail valido, password sicura) e abbia accettato i termini e le condizioni per i passeggeri applicabili nel rispettivo paese. L'Utente deve quindi registrare un metodo di pagamento disponibile per il servizio Pay by App, a seconda del paese di utilizzo (ad es. carta di credito o debito, PayPal, Apple Pay, Google Play).

(3) Qualsiasi persona fisica di età pari o superiore a 18 anni ha il diritto di partecipare e riscattare il buono. I nostri clienti business, i nostri Business Account e i loro rispettivi dipendenti che hanno ricevuto l'autorizzazione all'uso dell'App per il pagamento di corse per motivi di lavoro non possono partecipare alla suddetta promozione e in particolare non possono riscattare il buono per il pagamento tramite l’App di una corsa fatta per motivi di lavoro.

(4) Il riscatto è limitato all'importo massimo del valore del buono concordato. Anche nel caso di un buono emesso sotto forma di una quota percentuale dei costi del viaggio, il valore del buono può essere limitato a un importo massimo, che sarà notificato al momento dell'emissione del rispettivo buono. Se i costi sostenuti per un viaggio superano il valore del rispettivo buono, la differenza deve essere pagata dall'Utente.

(5) Il riscatto è consentito solo una volta entro il periodo di validità stabilito. Non è consentito alcun riscatto oltre il periodo di validità.

(6) Il buono e il relativo valore scadono dopo l'utilizzo. Non è possibile utilizzare il buono una seconda volta. Un buono scaduto non può essere sostituito. È escluso il pagamento in contanti di qualsiasi buono o valore di buono.

(7) L'Emittente, o la società operativa affiliata nel paese in cui il buono viene riscattato, può, a sua assoluta discrezione, bloccare e/o cancellare l'account dell'Utente se ha ragionevoli motivi per sospettare che l'Utente abbia utilizzato un buono in violazione delle presenti condizioni di riscatto, illegalmente, in modo fraudolento o in cattiva fede. L'Emittente, o la società operativa affiliata nel paese in cui il buono viene riscattato, avrà il diritto di chiedere all'Utente il rimborso di qualsiasi valore o servizio ottenuto in modo fraudolento.

4. Riscatto

(1) Dopo che l'Utente si è registrato come utente dell'app e ha attivato la funzione Pay by App (vedere la precedente sezione 3 (2) per i dettagli), per poter riscattare il buono deve depositare il buono che gli sarà notificato nell'app sotto forma di un codice buono corrispondente.

(2) Se entro il periodo di validità e l'ambito territoriale del suo buono, l'Utente (i) ordina un viaggio con l'App, termina il viaggio e paga con l'App o se, (ii) nel caso in cui l'Utente scelga un cosiddetto "hop on tour" con taxi (e il taxi non è stato ordinato con l'App), completi il viaggio e paghi tramite App, non è richiesto alcun pagamento fino al valore totale indicato sul buono precedentemente depositato dall'Utente. Se la fattura supera il valore del buono, la differenza deve essere pagata dall'Utente tramite l'app.

(3) Se si utilizza un buono in conformità alle presenti condizioni di riscatto per il trasporto di passeggeri via taxi, la tariffa di trasporto lorda continuerà a essere basata sulla tariffa taxi valida in base alle normative locali sui taxi applicabili nella rispettiva area di validità. Il taxista riceverà l'intera tariffa per il servizio effettuato (più eventuali mance che l'utente vorrà concedere e l'IVA applicabile). In caso di utilizzo di un buono valido per il trasporto di passeggeri in taxi, l'Emittente  detrarrà dalla ricevuta del taxi l'importo corrispondente al valore del buono.

(4) I buoni non possono essere cumulati con altre offerte, sussidi, buoni o sconti. I buoni non hanno alcun valore in denaro, non sono trasferibili e possono essere riscattati una sola volta. Il buono può essere riscattato solo inserendo il relativo codice. Non è possibile sostituire i buoni smarriti o rubati. Il buono non può essere venduto, rivenduto o riscattato in contanti.

5. Varie ed eventuali

(1) Qualora singole disposizioni delle presenti condizioni di riscatto fossero o divenissero nulle, la validità delle restanti disposizioni rimarrà invariata. La disposizione non valida verrà sostituita da una disposizione che si avvicini il più possibile all'intento della disposizione non valida.

(2) Le presenti condizioni di riscatto possono essere modificate dall'Emittente, in caso di incompletezza (aggiunte) delle stesse o qualora si verifichino successivi impedimenti di natura fisica o giuridica che possano materialmente compromettere o rendere impossibile lo scopo della rispettiva campagna promozionale alle presenti condizioni di riscatto.

(3) Le presenti condizioni di riscatto sono soggette alle leggi della Repubblica Italiana. Se l'Utente è un consumatore con residenza abituale nell'Unione Europea, l'Utente, in aggiunta, gode della tutela fornita dalle disposizioni obbligatorie della legge del proprio paese di residenza.
