Avvertenze sulla privacy per i tassisti, ai sensi del Regolamento generale UE sulla protezione dei dati (“GDPR“) per gli utenti dell'app FREE NOW per Tassisti.

La presente informativa fornisce una panoramica sul trattamento dei tuoi dati personali da parte nostra e sui tuoi diritti ai sensi delle disposizioni in materia di protezione dei dati in merito all’utilizzo del nostro servizio di prenotazione delle corse con taxi per passeggeri (“App FREE NOW per Tassisti”).
Il tipo di dati personali trattati dipende fondamentalmente dai sevizi o prodotti utilizzati.

Ai sensi dell’Articolo 4 comma 7 GDPR, per i tassisti presenti sul territorio italiano il titolare del trattamento è:

Il titolare del trattamento designa un responsabile della protezione dei dati. Il modo più semplice per contattare il nostro responsabile della protezione dei dati è inviando una mail a: https://driver.free-now.com/hc/it/requests/new oppure scrivendo all’indirizzo sopra riportato con oggetto "Responsabile della protezione dei dati".
E' fatto salvo quanto previsto all'art. 4.1 in ordine alla contitolarità di alcuni trattamenti ai sensi dell'art. 26 GDPR.
2. Definizioni
«dato personale»: qualsiasi informazione riguardante una persona fisica identificata o identificabile («interessato»); si considera identificabile la persona fisica che può essere identificata, direttamente o indirettamente, con particolare riferimento a un identificativo come il nome, un numero di identificazione, dati relativi all'ubicazione, un identificativo online o a uno o più elementi caratteristici della sua identità fisica, fisiologica, genetica, psichica, economica, culturale o sociale;
«Il "Gruppo FREE NOW"» è composto da Intelligent Apps GmbH, mytaxi Austria GmbH, mytaxi Network Ireland Ltd., mytaxi Italia Srl., mytaxi Polska Sp.z.o.o, FREE NOW Portugal Unipessoal Lda., mytaxi Iberia S.L., Clever Tech Srl., Transcovo SAS, Transopco SAS, Transopco UK Ltd.
«trattamento»: qualsiasi operazione o insieme di operazioni, compiute con o senza l'ausilio di processi automatizzati e applicate a dati personali o insiemi di dati personali, come la raccolta, la registrazione, l'organizzazione, la strutturazione, la conservazione, l'adattamento o la modifica, l'estrazione, la consultazione, l'uso, la comunicazione mediante trasmissione, diffusione o qualsiasi altra forma di messa a disposizione, il raffronto o l'interconnessione, la limitazione, la cancellazione o la distruzione;
3. Attività e finalità del trattamento dei dati
Qui di seguito desideriamo informarti in merito ai vari tipi di dati personali che trattiamo e per quali finalità.
Tramite l'AppFREE NOW per Tassisti sarà possibile aggiudicarti le corse, grazie a noi, con il taxi. Per utilizzare la nostra app FREE NOW per Tassisti per l'aggiudicazione delle corse, è necessario che tu fornisca i dati personali indicati nella presente informativa, che noi tratteremo per effettuare il rispettivo servizio. Potranno essere condivise, volontariamente, altre informazioni, che verranno indicate come “dati facoltativi“.Ove la fornitura dei dati di volta in volta richiesti non sia indicata come "facoltativa", essa s'intente necessaria per la prestazione dei relativi servizi FREE NOW: in tali casi, senza i tuoi dati FREE NOW non potrà fornirti i relativi servizi.
3.1. Aggiudicazione delle corse
Per ottenere i viaggi attraverso di noi, vengono trattati i seguenti dati personali:
3.1.1 Generale
È necessario fornire le seguenti informazioni per registrarsi al fine di utilizzare l'app FREE NOW per Tassisti:
Nome e cognome, data di nascita, città, Paese, indirizzo e-mail, numero di fax, numero telefono mobile, informazioni sulla licenza, le coordinate GPS durante l’accesso all’App FREE NOW per tassisti e al momento della chiamata, della partenza, del tragitto e dell’arrivo a destinazione di una determinata corsa, informazioni sul dispositivo (ID del dispositivo, momento dell’accesso all’App FREE NOW per tassisti, tipo di browser e sistema operativo), informazioni sulla compagnia di servizio taxi (per tassisti con contratto di lavoro subordinato), indirizzo aziendale (per tassisti titolari di imprese individuali), dati sulle recensioni dei passeggeri (da 1 a 5 stelle per tassista, veicolo e media recensioni), targa registrata, colore e marchio del taxi, stato disponibilità, User ID, numero di corse, fatturato, tasso di corse portate a termine e interrotte, informazioni sul pagamento da parte dei passeggeri incluse mance e la password scelta in formato criptato, indirizzo di lavoro, immagine del profilo. Le voci opzionali saranno utilizzate solo se inserite.
Se ti sei registrato all’app FREE NOW per Tassisti, ma non hai completato il processo di on-boarding in qualità di driver, potremmo contattarti utilizzando l'indirizzo email e numero di telefono che hai fornito durante il processo di registrazione per ricordarti che l'on-boarding non è ancora completo. Per effettuare questo trattamento ci basiamo sul nostro legittimo interesse [(Art. 6 (1) f) GDPR)] a sostenere la nostra attività.
L'utilizzo dei dati di localizzazione GPS da parte di FREE NOW può essere consentito al momento dell'installazione dell'app FREE NOW per Tassisti. Tramite il sistema operativo del dispositivo dell'utente finale (smartphone, tablet, ecc.), è anche possibile dare il consenso, in un secondo momento, per l'uso delle coordinate GPS da parte di FREE NOW oppure revocare il consenso. Nel caso di mancata condivisione con noi delle tue coordinate GPS, non potremo affidare delle corse né a tené alla tua Azienda di trasporti, poiché comunichiamo le richieste dei passeggeri proprio in base alla posizione, per poter arrivare nel più breve tempo possibile.
Ai fini dell'identificazione, mostreremo le tue coordinate GPS, il tuo nome e, se è a nostra disposizione, la foto del tuo profilo e il numero di targa al passeggero che ha prenotato la corsa. Una volta accettata la corsa, durante la corsa e per un certo tempo dopo la conclusione della corsa stessa, il passeggero potrà chiamarti utilizzando l'app Passeggeri FREE NOW. A tale riguardo utilizziamo un servizio di mascheramento del numero telefonico (si veda il punto 3.1.2). In questo modo il passeggero potrà chiamarti anche dopo la corsa, ad esempio per chiederti informazioni su oggetti dimenticati nel veicolo, ma non potrà vedere il tuo numero di telefono.
Senza il trattamento dei suddetti dati personali, non possiamo procurarti delle corse. Ciò non vale per le informazioni facoltative.
Quando i passeggeri prenotano un tour nella vostra zona, visualizziamo la vostra foto, il vostro nome e la vostra valutazione media durante l'organizzazione del tour. Il passeggero non ha la possibilità di preferire un autista specifico sulla base di queste informazioni. Il trattamento si basa sul legittimo interesse di presentare al passeggero il processo di organizzazione del tour in modo più personalizzato e trasparente. Il passeggero può opporsi a questo trattamento utilizzando le informazioni di contatto fornite qui, in modo che i suoi dati non vengano visualizzati in questo caso.
3.1.2. Autenticazione multifattoriale e mascheramento del numero di telefono tramite Twilio
Per motivi di sicurezza, quando ti registri per la prima volta o accedi da un nuovo dispositivo mobile nell'App FREE NOW per Tassisti, verifichiamo la tua registrazione inviandoti un codice via SMS o via e-mail ("autenticazione multifattoriale "). Usiamo il fornitore di servizi Twilio Inc. 375 Beale St, Suite 300 San Francisco, CA 94105, USA ("Twilio") per inviare l'SMS. Al fine di proteggere al meglio i tuoi dati, utilizziamo anche il servizio chiamate di Twilio per mascherare il tuo numero di telefono così da non mostrarlo al relativo passeggero. Il passeggero potrà comunque chiamarti (tramite Twilio) ma non conoscerà il tuo numero di telefono.
Abbiamo concluso un accordo per il trattamento dei dati con Twilio per assicurarci che i tuoi dati siano trattati solo nel rispetto delle nostre istruzioni e in osservanza delle leggi applicabili in materia di protezione dei dati. La legittimità del trasferimento dei dati negli USA è assicurata dalle Binding Corporate Rules di Twilio ai sensi di quanto previsto all’ Art. 47 GDPR. Inoltre abbiamo concluso delle standard contractual clauses (SCCs) con Twilio.

3.1.3. Contattare FREE NOW
FREE NOW fornisce diversi mezzi di contatto ai suoi clienti, come il nostro modulo di contatto online: https://driver.free-now.com/hc/it/requests/new. Puoi inoltre contattare FREE NOW per posta o telefonicamente. Ogni volta che entri in contatto con FREE NOW, conserviamo e trattiamo i tuoi dati personali.
A seconda del mezzo di contatto da te scelto, FREE NOW tratta i seguenti dati personali:
nome, indirizzo e-mail, paese, numero di telefono, registrazioni vocali, contenuto dei messaggi, allegati.
La base giuridica di questo trattamento è, in generale, secondo l'art. 6 (1) f) GDPR, il nostro legittimo interesse nel rispondere ai tuoi messaggi. Quando entri in contatto con FREE NOW al fine di stipulare un contratto o in ragione di un contratto in essere, la base giuridica è l'art. 6 (1) b) del GDPR.
Per utilizzare il nostro modulo online basta solo fornirci l'indirizzo e-mail per permetterci di rispondere al tuo messaggio. Le comunicazioni con FREE NOW vengono cancellate dopo 3 anni, sulla base del nostro legittimo interesse, come sancito dall'art. 6 (1) f) del GDPR, per l’instaurazione, l'esercizio o la difesa da contenziosi.
Per offrirti il nostro miglior servizio, collaboriamo con Zendesk, Inc. 1019 Market Street, San Francisco, CA 94103, USA. La trasmissione dei tuoi dati personali è assicurata da clausole contrattuali standard e regole aziendali vincolanti in conformità con l'art. 46 del GDPR.

3.1.4. Integrazione di Google Maps
L'app FREE NOW per Tassisti utilizza l'API di Google Maps fornita da Google Ireland Limited Gordon House, Barrow Street Dublino 4 (“Google”). In questo modo, puoi visualizzare le mappe nell'app FREE NOW per Tassisti e avere la possibilità di interagire con tali mappe. Senza l'applicazione API di Google Maps, l'app FREE NOW per Tassisti non funzionerà. I termini di utilizzo per Google Maps sono disponibili all'indirizzo: https://www.google.com/help/terms_maps.html. Lì troverai anche un avviso relativo all'informativa sulla privacy di Google: https://policies.google.com/privacy?hl=de. Utilizziamo Google Maps per calcolare il costo previsto della corsa e per mostrarti in modo interattivo la distanza dal passeggero che ha prenotato la corsa. In questo contesto, se hai acconsentito a tale utilizzo, le tue coordinate di localizzazione GPS verranno trattate ai sensi dell'Art. 6 (1) f) GDPR. Le tue coordinate GPS verranno fornite a Google solo in forma anonima. L'identificazione di te, come persona, non è possibile.
3.1.5 Collaborazione con parti terze
FREENOW si avvale anche di parti terze per offrire i suoi servizi. Se un passeggero richiede una corsa attraverso un fornitore esterno, i tuoi dati personali (ad esempio, nome, foto, numero di registro del veicolo e numero della patente) possono essere condivisi con quel fornitore esterno con il solo scopo di condividere questa informazione con il passeggero che ha richiesto il servizio.
3.2. Pagamento
Per consentire la gestione dei pagamenti ai sensi del vigente “Contratto quadro di appalto mytaxi” o del “Contratto quadro di appalto di FREE NOW” e dei “Termini e condizioni per le società di taxi”, verranno trattati i seguenti dati personali ai sensi dell'Art. 6 (1) b) GDPR con la finalità dell'esecuzione del contratto:
Nome e cognome, numero di corse, fatturato, e, nel caso in cui tu sia un'Azienda di trasporti, informazioni di pagamento e coordinate bancarie. I dati relativi al pagamento sono disponibili sul Portale FREE NOW.
3.3. Valutazione di tassisti e passeggeri
Tramite l'app Passeggeri FREE NOW, i passeggeri possono fornire valutazioni su di te e sul tuo veicolo, dopo una corsa, con un valore tra 1 e 5. Le singole valutazioni confluiscono nel valore medio che calcoliamo per te e per il tuo veicolo. La singola valutazione è visibile solo per il passeggero che l'ha immessa, per te in qualità di tassista e per FREE NOW. Per i tassisti dipendenti di un'Azienda di trasporti, trasmetteremo la singola valutazione all'Azienda di trasporti unicamente con il vostro consenso.
Inoltre, i passeggeri possono aggiungere i tassisti che vogliono tra i tassisti preferiti, nel loro profilo della App Passeggeri FREE NOW. In tal caso, verranno salvati il nome e cognome, la valutazione, e la foto del profilo nella App Passeggeri FREE NOW del relativo passeggero.
Il trattamento di questi dati avverrà sulla base del nostro legittimo interesse, ai sensi dell'Art. 6 (1) f) GDPR, per assicurare uno standard di qualità ragionevole e garantire la sicurezza del passeggero.
Oltre a ciò, c'è la possibilità di dare una valutazione al passeggero. Le valutazioni sono visibili solo per FREE NOW e verranno trasmesse solo al passeggero interessato, su richiesta, in forma anonimizzata. Il trattamento dei dati personali, da parte di FREE NOW, avverrà sulla base del tuo consenso, ai sensi dell'Art. 6 (1) a) GDPR che avrai dato fornendo la valutazione.
3.4. Misure antitruffa e mancati pagamenti
3.4.1 Punteggio di frode
FREE NOW ha investito per rendere la sua piattaforma uno spazio sicuro per passeggeri e tassisti. Pertanto, FREE NOW ha implementato misure per individuare e vietare comportamenti fraudolenti al fine di proteggere passeggeri e tassisti. Inoltre, FREE NOW vuole ridurre il rischio di danni finanziari dovuti a comportamenti fraudolenti. Per questo motivo, FREE NOW effettuerà una valutazione del rischio di comportamenti fraudolenti sulla base di un modello matematico-statistico (scoring). Questo trattamento si basa sul suddetto interesse legittimo ai sensi dell'art. 6 (1) f) GDPR.
Per determinare il punteggio (scoring), saranno trattati i seguenti dati personali:
- Dati del passeggero e del tassista come: numero di telefono, indirizzo e-mail, nome, identificatori del dispositivo,
- Dati del tour come: lunghezza del tour, distanza dal passeggero, incentivi utilizzati, valore del tour, luogo di partenza e luogo di destinazione,
- Dati di pagamento come: metodo di pagamento.
I valori derivanti da questi dati vengono confrontati con una serie di scenari precedentemente definiti che indicano un comportamento fraudolento. In base al numero di scenari identificati, il nostro fornitore europeo di servizi di prevenzione delle frodi calcolerà un punteggio che rivela la probabilità di un comportamento fraudolento. Sulla base di tale punteggio, un dipendente di FREE NOW appositamente addestrato indagherà ulteriormente se vi può essere una conferma di un comportamento fraudolento. Il punteggio non sarà utilizzato per alcun processo decisionale automatizzato. Qualsiasi azione intrapresa non sarà mai giustificata dal punteggio e coinvolgerà sempre un supervisore umano.
3.4.2 Posizionamento GPS
Al fine di prevenire attività fraudolente, memorizziamo i dati di localizzazione GPS che ci vengono inviati dal tuo dispositivo mobile a brevi intervalli dal momento dell'accettazione fino alla fine di un tour. Questo permette a FREE NOW di creare una mappa dell'intero percorso del tour. In questo modo intendiamo evitare che gli autisti allunghino deliberatamente il percorso per ottenere una tariffa più alta. Allo stesso tempo, potendo seguire l'effettivo corso e percorso di un tour, saremo in grado di identificare eventuali reclami ingiustificati dei passeggeri. L'elaborazione dei tuoi dati di localizzazione GPS durante un tour è realizzata a tua tutela, a tutela del passeggero e per nostra stessa tutela, sulla base dell'Art. 6 (1) f) GDPR.
3.5. Risoluzione dei bug (errori di funzionamento) e miglioramento del funzionamento
Al fine di correggere i bug (errori di funzionamento) e di migliorare il funzionamento dell'app FREE NOW per Tassistie adattarla alle esigenze dei tassisti, trattiamo i seguenti dati personali, ai sensi dell'Art. 6 (1) f) GDPR sulla base del nostro legittimo interesse:
Nome e cognome, data di nascita, città,Paese, indirizzo e-mail, numero di fax, numero di cellulare, informazioni relative alla licenza, coordinate GPS quando stai usando l'App FREE NOW per Tassisti e al momento della chiamata, orario di partenza, orario durante la corsa e orario alla destinazione della corsa, informazioni sul tuo dispositivo (ID del dispositivo, orario di accesso all'App FREE NOW per Tassisti, tipo di browser e sistema operativo), informazioni sull'Azienda di trasporti (per i tassisti che non sono essi stessi Aziende di trasporti), indirizzo dell'Azienda (per i tassisti che sono, nel contempo, anche Aziende di trasporti), informazioni relative alle valutazioni dei passeggeri (da 1 a 5 stelle per il tassista e il veicolo e per la valutazione media), numero di targa, colore e marca del veicolo, disponibilità, ID utente, numero di corse, fatturato, tasso di corse portate a termine e interrotte, informazioni sul pagamento da parte dei passeggeri, incluse mance, e la password scelta, in formato criptato.
Nella misura in cui è sufficiente per il raggiungimento dello scopo corrispondente, lavoriamo con dati anonimi piuttosto che con dati personali.
Al fine di migliorare il nostro tempo di risposta agli errori all'interno dell'App FREE NOW e le prestazioni della nostra App, lavoriamo con il fornitore di servizi DataDog Inc, New York Times Bldg, 620 8th Ave, Fl 45, New York, NY 10018, USA. Tutti i dati trattati da Datadog vengono automaticamente cancellati dopo un massimo di 30 giorni.
I trasferimenti di dati personali ad Apptimize e Datadog sono garantiti da clausole tipo di protezione secondo l'art. 46 GDPR. Esiste un livello adeguato di protezione dei dati.

3.6. News e offerte personalizzate
3.6.1. Generale
Se, durante l’installazione dell’App FREE NOW per Tassisti concederai il permesso dì inviarti notifiche push, FREE NOW ti invierà notifiche push in base al consenso fornito. Tale consenso si intenderà superato qualora, nel corso del processo di registrazione o in un momento successivo, nel profilo dell’App FREE NOW per Tassisti alla voce “Privacy” tu abbia acconsentito all’invio di news e offerte personalizzate (pubblicità, buoni e offerte) e alla visualizzazione di pubblicità basata sull’utilizzo (“Retargeting”) e abbia attivato l’opzione corrispondente; in tal caso riceverai offerte e pubblicità da parte nostra e anche per prodotti e servizi di altre società del Gruppo FREE NOW. Tale servizio consiste nell'invio di pubblicità personalizzata tramite posta elettronica (e-mail, SMS, MMS) o altri mezzi elettronici (notifiche in-app, notifiche push) al tuo dispositivo (smartphone, tablet, PC, ecc.).
A tal proposito, trattiamo i seguenti dati personali, ai sensi dell’Art. 6 (1) a) GDPR, nella misura in cui ci hai dato il corrispondente consenso:
Nome e cognome, ID del tassista, indirizzo e-mail, indirizzo del lavoro, numero di cellulare, foto del profilo (dato facoltativo), data di registrazione, lingua impostata, tipo di corsa (chiamata, corsa al volo), versione dell’App FREE NOW per Tassisti, dati di accesso, coordinate GPS al momento della chiamata e al termine della corsa, o luogo di presa e destinazione, ID del dispositivo (codice identificativo del dispositivo), IDFA (identificativo pubblicitario, identificativo Apple per inserzionisti), GAID (Identificativo pubblicitario Google), indirizzo IP e dati sull’utilizzo (frequenza di utilizzo, numero di installazioni dell’app FREE NOW per Tassisti, stato di registrazione e delle corse), lingua, fuso orario e città.
Se non desideri ricevere le news e le offerte personalizzate di cui sopra, potrai revocare il tuo consenso, disattivando l’opzione corrispondente; l’operazione di revoca è semplice da esercitare tanto quanto quella di consenso. Potrai inoltre contattarci scrivendo un’e-mail a https://driver.free-now.com/hc/it/requests/new oppure inviando una lettera informale a mytaxi Italia Srl., Via Privata del Gonfalone 2,20123 Milano.
Ti ricordiamo che la revoca e le modifiche conseguenti non avranno effetto retroattivo e potranno essere necessarie fino a 48 ore dalla richiesta prima che vengano attuate. Per motivi tecnici non ci è possibile agire più rapidamente.
3.6.2. Pubblicità diretta per clienti già esistenti
Una volta ricevuto il tuo indirizzo e-mail o il numero di cellulare per la fornitura del nostro servizio e una volta che hai completato una corsa utilizzando il nostro servizio, potremo utilizzare questi dati per la pubblicità diretta per i nostri prodotti e servizi via posta elettronica (e-mail, SMS e MMS), a meno che tu non abbia rifiutato il servizio di pubblicità diretta. A tale scopo, sulla base del nostro legittimo interesse ai sensi dell'Art. 6 (1) f) GDPR, trattiamo i seguenti dati: il tuo indirizzo e-mail e il tuo numero di cellulare. Il nostro legittimo interesse risiede nell'intensificare il rapporto con il cliente, proponendogli informazioni adeguate e interessanti sui prodotti. È possibile disdire il servizio, in qualsiasi momento, cliccando sull‘apposito link in fondo alla rispettiva mail (ad es. annullare l’iscrizione alla newsletter) oppure contattandoci via SMS, senza effetto retroattivo. La pubblicità diretta da noi inviata non è personalizzata. Ricordiamo che la revoca e le modifiche conseguenti non avranno effetto retroattivo e potranno essere attuate entro e non oltre 48 ore dalla richiesta. Per motivi tecnici non ci è possibile agire più rapidamente.
3.6.3. Uso della tecnologia AppsFlyer
Utilizziamo i servizi di AppsFlyer Ltd., 14 Maskit St., Herzliya, Israele ("AppsFlyer”), per avere maggiori informazioni su come gli utenti raggiungono e utilizzano la nostra app. Quando si utilizzano tali servizi, vengono raccolte, trattate e utilizzate informazioni sui dispositivi utilizzati dagli utenti, il loro comportamento online e il contenuto delle paginea cui accedono. Ciò vale in particolare per informazioni quali:
AppsFlyer utilizza questi dati per nostro conto, per valutare e analizzare le prestazioni delle nostre attività edei nostricanali di marketing, per scoprire come gli utenti rispondono a campagne specifiche, come usano l'app e interagiscono con essa. I dati sopra descritti non vengono utilizzati per individuare singoli utenti né per associarlia una persona specifica. Inoltre, i dati vengono utilizzati per rilevare e prevenire i casi delle cosiddette “frodi mobili”, cioè azioni manipolative e fraudolente relative alle nostre misure di marketing.Sulla base dei dati raccolti, che vengono aggregati nel corso del processo, AppsFlyer può identificare, per noi, se alcune azioni relative alla nostra app (ad esempio download o installazione) sono state manipolate. Questo serve anche peri nostri interessi commerciali, poiché dobbiamo considerare tali azioni fraudolente nel processo di fatturazione con i nostri partner, con cui collaboriamo (reti pubblicitarie / siti web partner che mostrano le nostre pubblicità). Il trattamento di tali dati si basa quindi sulla cosiddetta clausola sul bilanciamento degli interessi di cui all'Art. 6 (1) f) GDPR e sul nostro legittimo interesse, secondo quanto descritto sopra.

Per l'invio di comunicazioni di servizio, ci avvaliamo del fornitore di servizi "MailChimp", gestito da Rocket Science Group, LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.
I dati personali trattati comprendono
Abbiamo stipulato con i nostri fornitori di servizi un contratto per il trattamento dei dati, che garantisce che il fornitore di servizi tratti esclusivamente i tuoi dati personali secondo le nostre istruzioni e in conformità con la legge sulla protezione dei dati. Inoltre abbiamo stipulato con Braze clausole tipo per la protezione dei dati (standard contractual clauses - CCS) ai sensi dell’Art. 46 del GDPR al fine di garantire un adeguato livello di protezione dei dati personali durante il loro trattamento.

3.6.5. Facebook Custom Audiences
Collaboriamo con Facebook Custom Audiences per mostrarti annunci personalizzati sui nostri servizi tramite il social network Facebook, un servizio di Facebook Ireland Limited, 4 Grand Canal Square, Dublino 2, Irlanda (“Facebook”), e su pagine partner di Facebook. Tale servizio consente di formulare gli annunci (ad es. i banner) in modo che corrispondano alle eventuali necessità del cliente. Alla base vi è innanzitutto la cosiddetta procedura di aggiunta tag, con la quale il dispositivo del cliente (ad es. uno smartphone), trasmette automaticamente o manualmente a Facebook un cosiddetto codice identificativo pubblicitario (IDFA o GAID) tramite una determinata interfaccia, attraverso l’utilizzo di un fornitore di servizi selezionato da FREE NOW. L'identificativo pubblicitario è individuale, ma non è personalizzato e non è un numero identificativo permanente, per un determinato utente finale iOS o Android. Se non vuoi che l'identificativo pubblicitario venga trasmesso, per iOS, vai sotto “Impostazioni” – “Protezione dati” – “Pubblicità” e seleziona l'opzione “nessun monitoraggio degli annunci” oppure, per Android, vai sotto “Impostazioni” – “Google” – “Pubblicità” e seleziona l'opzione “disattiva annunci personalizzati.” Inoltre, hai la possibilità, in qualsiasi momento, di cancellare l'identificativo pubblicitario nelle impostazioni del dispositivo (iOS: “Resetta Ad-ID”; Android: “Resetta Advertising-ID”). Verrà generato un nuovo numero identificativo per il tuo dispositivo, che non verrà associato ai dati ottenuti in precedenza dal tuo dispositivo. Dopo la trasmissione degli identificativi pubblicitari, FREE NOW creerà un elenco di clienti che hanno effettuato determinate azioni con l’App FREE NOW per Tassisti. È possibile selezionare solo determinate azioni predefinite (ad es. l’installazione dell’App FREE NOW per Tassisti negli ultimi 30 giorni). Facebook associa l’identificativo pubblicitario del cliente a quello di persone con un profilo Facebook, determinando così gruppi di utenti specifici (ad es. gruppo 1 = installazione negli ultimi 30 giorni) e visualizzando annunci personalizzati in base al gruppo.Facebook può anche usare i dati per selezionare altri utenti Facebook con comportamenti statisticamente simili a quelli dei clienti o degli utenti dell'app (i cosiddetti gemelli statistici, denominati, da Facebook, pubblico sosia). In questo modo, la nostra pubblicità potrà raggiungere persone che non stanno ancora usando i nostri servizi, ma che, con grande probabilità, potrebbero essere interessate a farlo. Al contempo, iclienti che non sono utenti Facebooknon possono essere messi a confronto da parte di Facebooke pertanto non riceveranno annunci.Tuttavia, con il vostro consenso, potremo trasmettere il tuo indirizzo e-mail manualmente a Facebook, in forma crittografata (la cosiddetta procedura hash). Facebook controllerà se l'indirizzo e-mail trasmesso corrisponde a clienti Facebook già esistenti. Se viene trovata corrispondenza, a questi gruppi mirati verranno mostrati annunci/campagne da parte di FREE NOW, su Facebook o sui siti web dei partner di Facebook. Con riferimento a Facebook Custom Audiences, trattiamo i seguenti dati ai sensi dell’Art. 6 (1) a) GDPR: codice identificativo web (IDFA di Apple oppure GAID di Google) e indirizzo e-mail.
Se non de sideriche i tuoi dati vengano trattati in relazione aFacebook Custom Audiences, potrai revocare il tuo consenso nelle “Impostazioni per la protezione dei dati“ dell'App FREE NOW per Tassisti *(sotto l'opzione “Profilo“), disattivando l'opzione relativa a “Pubblicità personalizzata”; l’operazione di revoca è semplice da esercitare tanto quanto quella di consenso. Potrai inoltre contattarci scrivendo un’e-mail a https://driver.free-now.com/hc/it/requests/new oppure inviando una lettera informale a mytaxi Italia Srl., Via Privata del Gonfalone 2,20123 Milano.
Ti ricordiamo che la revoca e le modifiche conseguenti non avranno effetto retroattivo e potranno essere necessarie fino a 48 ore dalla richiesta prima che vengano attuate. Per motivi tecnici non ci è possibile agire più rapidamente.
3.6.6. Mobile Attribution Tracking
Utilizziamo i provider di servizi Pinterest (Pinterest Europe Ltd, Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Irlanda; "Pinterest"), Snapchat (Snap Group Ltd, 77 Shaftesbury Avenue, London, W1D 5DU, Regno Unito; "Snapchat"), Twitter (Twitter International Company, One Cumberland Place, Fenian Street, Dublin 2, D02 AX07, Irlanda; "Twitter”) e AdTriba (AdTriba GmbH, Beim Schlump 13a, 20144 Hamburg, Germania; „AdTriba“) per portare avanti campagne di marketing a seconda della richiesta, ottimizzarle e misurarne la portata. In tal modo garantiamo che le singole campagne di marketing vengano mostrate solo a quegli utenti che abbiano già mostrato interesse verso le nostre offerte FREE NOW e che, in tal modo, rispecchino il potenziale interesse del singolo utente. Inoltre possiamo tracciare il comportamento degli utenti che abbiano precedentemente cliccato su una delle nostre campagne di marketing FREE NOW. Ciò ci aiuta a valutare la portata di ogni campagna per finalità statistiche, di mercato e di fatturazione interna.
Verranno trattati i seguenti dati personali:
Informazioni sul dispositivo (ad es. tipo, marca), Identificatori pubblicitari (IDFA), sistema operativo utilizzato, indirizzo IP, data e ora della chiamata alla nostra offerta, tipo e contenuto della campagna e il comportamento del clic in relazione a una campagna.
Il trattamento avviene sulla base degli interessi legittimi a pubblicità basata sul comportamento e sugli interessi ai sensi dell’Art. 6, comma 1, lettera f) del GDPR in combinato disposto con il preambolo 47 al GDPR. Se si è contemporaneamente effettuato l’accesso con il proprio account utente, il relativo provider di servizi è in grado di collegare tali dati personali all’account stesso e utilizzarli per i propri scopi pubblicitari. 3.7. Ricerche e sondaggi
3.7.1. Informazioni generali
Se, nel corso della procedura di registrazione oppure in un momento successivo, nel tuo profilo dell’App FREE NOW per Tassisti, alla voce “Protezione dei dati”, hai acconsentito alle ricerche e ai sondaggi attivando l’opzione corrispondente, al termine di una corsa o anche in altri momenti riceverai la richiesta di partecipare a ricerche e sondaggi personalizzati (inviati solo a te basandosi sull’analisi della frequenza con cui usufruisci dell’App FREE NOW per Tassisti) tramite posta elettronica (e-mail, SMS, MMS) o altri mezzi elettronici (notifiche in-app, notifiche push). Ad esempio, a intervalli regolari svolgiamo apposite campagne, tramite le quali puntiamo ad aumentare e ottimizzare le corse da noi organizzate. Nell’ambito di studi e sondaggi, potremmo trattare i seguenti dati personali nel rispetto dell’Art. 6, comma 1, lettera a) del RGDP:
Nome e cognome, ID Tassista, indirizzo e-mail, indirizzo del lavoro, numero di cellulare, foto del profilo (dato facoltativo), modalità di pagamento, data di registrazione, lingua impostata, profilo dell’App FREE NOW per Tassisti (cliente aziendale o privato), tipo di corsa (chiamata, corsa al volo), versione dell’App FREE NOW per Tassisti, dati di accesso (nome utente), coordinate GPS al momento della chiamata e al termine dell’accorsa dati sull’utilizzo (frequenza di utilizzo, informazioni sul numero di installazioni dell’app FREE NOW per Tassisti, di registrazioni o di corse in taxi), data di registrazione, data dell’ultimo accesso, Push-token,ID dispositivo (identificativo del dispositivo), IDFA (identificativo annuncio, identificativo Apple per inserzionisti), IFV (identificativo annuncio, identificativo venditore), GAID (identificativo annuncio Google) e indirizzo IP.
Se non desideri essere contattato a questo scopo, potrai revocare il tuo consenso, disattivando l’opzione “Ricerche e sondaggi”; l’operazione di revoca è semplice da esercitare tanto quanto quella di consenso. Calendly fornisce al livello mondiale una piattaforma che facilita la programmazione di appuntamenti e tratta pertanto i tuoi dati personali. Calendly assicura di non memorizzare l'identità della persona con cui l'utente si incontra, la sua e-mail, il titolo della riunione o qualsiasi altro dettaglio sugli appuntamenti. A seconda dei dati da te forniti volontariamente, possono essere trattati i seguenti dati:
La base giuridica per questo trattamento è il tuo consenso liberamente fornito ai sensi dell'art. 6 (1) a) del GDPR. Calendly garantisce che il trattamento dei dati personali è soggetto ad un adeguato livello di protezione, in quanto vengono rispettati i requisiti della legge europea sulla protezione dei dati. FREE NOW ha effettuato una valutazione dei rischi per questo trasferimento di dati personali in un paese terzo e ritiene che il livello di protezione dei dati sia adeguato per quanto riguarda le misure di sicurezza implementate. Inoltre, abbiamo concluso clausole contrattuali standard (SCC) con Calendly in conformità all'art. 46 del GDPR per garantire un adeguato livello di protezione dei dati.

Informazioni sull’utilizzo dei tuoi dati personali da parte dei rispettivi provider di social media sono reperibili nelle rispettive informative sul trattamento dei dati personali di questi servizi:
Trattiamo i dati tramite i nostri profili di social media nella misura in cui gli utenti delle piattaforme di social media utilizzano il nostro profilo per inviare direttamente a noi messaggi o commenti. La base giuridica per il trattamento dei dati è pertanto il consenso del rispettivo utente ai sensi dell’art. 6, par. 1, lett. a) GDPR o, nel caso di richieste contrattualmente rilevanti, l’art. 6, par. 1, lett. b) del GDPR. Eventualmente, condivideremo i tuoi contenuti sul nostro sito se ciò è consentito da una funzione della piattaforma di social media e comunichiamo con te tramite la piattaforma di social media. La base giuridica di ciò è costituita dall’art. 6, par. 1, frase 1, lett. f) del GDPR. 4. Scambio di dati all’interno del gruppo FREE NOW
Per scopi amministrativi e di uniformazione interni, possiamo trasmettere informazioni personali di conducenti o passeggeri all’interno del gruppo FREE NOW. La base giuridica di ciò è costituita dal nostro legittimo interesse per un’efficace gestione d’impresa, art. 6 (1) f) GDPR, vedi anche il Considerando 48 del GDPR.
4.1. Accordo di contitolarità
FREE NOW ha sottoscritto un accordo di contitolarità ai sensi dell’art. 26 del RGPD con Intelligent Apps GmbH, Neumühlen 19, 22763 Hamburg, Germania (“Intelligent Apps”). Le Parti hanno determinato congiuntamente l’ordinamento relativo al trattamento dei suoi dati personali in ciascuna sezione del trattamento.
Lo scopo di questo accordo è quello di unificare il trattamento dei dati del conducente e la fatturazione in tutto il gruppo FREE NOW. Le Parti hanno concordato congiuntamente quali sono gli obblighi che ciascuna parte è tenuta a rispettare nel quadro del GDPR.
Intelligent Apps elabora congiuntamente i dati personali dei driver di FREE NOW per migliorare il soft-ware dell'applicazione FREE NOW Driver e fornire know-how tecnico a FREE NOW. FREE NOW è responsabile dell'elaborazione di tutti i dati relativi all'utilizzo locale dell'applicazione FREE NOW Driver.
Malgrado l’esistenza di una contitolarità, le Parti ottemperano agli obblighi previsti dalla legge sulla protezione dei dati in conformità alle rispettive competenze. Le Parti sono tenute a fornirle qualsiasi informazione a cui si faccia riferimento negli articoli 13 e 14 del GDPR gratuitamente, in forma concisa, trasparente, comprensibile e facilmente accessibile e utilizzando un linguaggio chiaro e semplice. A tal proposito, ciascuna Parte è tenuta a fornire all’altra Parte tutte le informazioni necessarie riguardanti i rispettivi ambiti operativi. Le Parti dovranno immediatamente informarsi reciprocamente in merito all’esercizio dei suoi diritti in qualità di interessato e fornire all’altra Parte tutte le informazioni necessarie che facciano riferimento al diritto di accesso. In base agli articoli dal 15 al 22 del GDPR, può esercitare i suoi diritti di interessato nel quadro del RGPD nei confronti di e contro ciascuna delle Parti. Tuttavia, per velocizzare i tempi di risposta, le chiediamo gentilmente di esercitare i suoi diritti presso https://driver.free-now.com/hc/it/requests/new.

5. Elaborazione all'interno e all'esterno dell'Unione Europea / Spazio Economico
Per trattare i dati, ci avvaliamo in parte di fornitori di servizi esterni (ad es. risoluzione dei problemi, preparazione di mail). A tal fine è necessario trasmettere ai nostri fornitori di servizi esterni i tuoi dati personali per la finalità specifica (limitatamente alla finalità in questione). Abbiamo selezionato con cura i nostri fornitori di servizi, che hanno ricevuto un incarico per iscritto; sono vincolati alle nostre istruzioni e ci siamo informati sulle loro misure tecniche e organizzative atte a tutelare la sicurezza nel trattamento dei dati personali. Inoltre, richiediamo a tutti i nostri fornitori di servizi di rispettare la normativa vigente in materia di protezione dei dati. Collaboriamo con fornitori di servizi dell’UE e dei Paesi esteri del SEE. Con tutti i nostri fornitori di servizi esterni abbiamo stipulato contratti ai sensi dell’Art. 28 (3) GDPR, nella misura in cui ciò è richiesto ai fini contrattuali. Il trasferimento ai fornitori di servizi al di fuori dello Spazio Economico Europeo ha luogo nel rispetto delle decisioni prese dalla Commissione UE ai sensi dell'Art. 45 GDPR o nel rispetto delle clausole contrattuali tipo dell’UE.
In caso di un ritiro non regolamentato del Regno Unito dall’Unione europea (“hard brexit”), che renderebbe il Regno Unito, almeno temporaneamente, un Paese terzo (extra-UE) in termini di protezione dei dati, abbiamo stipulato clausole contrattuali standard (SCC) con la nostra sede nel Regno Unito al fine di garantire la legalità generale del trasferimento dei dati
Memorizziamo tutti i nostri dati presso un fornitore di servizi cloud all’interno dell’UE oppure in infrastrutture sistemi IT (computer dei dipendenti) nelle nostre sedi all’interno dell’UE.
Tuttavia, ci riserviamo il diritto di comunicare le tue informazioni, se siamo tenuti da obblighi di legge oppure se ci verrà richiesto da organismi amministrativi o da organi incaricati dell’applicazione della legge (ad es. polizia, procura dello Stato).
6. I tuoi diritti

FREE NOW è certificata PCI DSS (Payment Card Industry Data Security Standard).
8. Periodo di conservazione
I dati da te fornitici vengono conservati solo per il tempo necessario per le rispettive finalità per le quali hai trasmesso i tuoi dati, o nella misura richiesta per conformità con le prescrizioni di legge o ufficiali. The information provided below gives you an overview over the Processing of your personal data by us and your rights under data protection law in connection with the use of our app for procuring Journeys for Drivers (“FREE NOW Driver App”).
Which personal data is processed is substantively determined based on the services or products you use.

2. Definitions
“Personal data“ is all information which relates to an identified or identifiable natural person. Among these are, for example, name, postal address, e-mail address or telephone number, but also usage data like your IP address.
“FREE NOW Group“ consists of Intelligent Apps GmbH, mytaxi Austria GmbH, mytaxi Network Ireland Ltd., mytaxi Italia Sr., mytaxi Polska Sp.z.o.o, FREE NOW Portugal Unipessoal Lda., mytaxi Iberia S.L., Clever Tech Srl., Transcovo SAS, Transopco SAS, Transopco UK Ltd.
“Processing“ is every process carried out with or without automated assistance or every sequence of such processes in connection with personal data, e.g. obtaining, capturing, organizing, ordering, saving, adjusting or modifying, sorting, accessing, using, disclosing by transmission, distributing or any other form of making available, comparing or connecting, limiting, deleting or destroying.
3. Data Processing Activities and Purposes
In the following, we will inform you about the various types of personal data we process and for what purpose. The FREE NOW Driver App makes it possible for you to procure Journeys through us with Passengers. For the use of our FREE NOW Driver for procurement of Journeys, you must provide personal data which we process in order to perform the respective service. If additional information can be voluntarily shared, these are indicated as being “optional“.
3.1. Journey Procurement
To procure journeys through us, the following personal data is processed:
3.1.1. General
To register for use of the FREE NOW Driver App, you must provide the following information:
First name and surname, date of birth, city, country, e-mail address, mobile phone number, information regarding your license, your GPS coordinates while being logged in to the FREE NOW Driver App and the same at time of booking, at the start, during the course of and at the destination of a particular Journey, information regarding your end user device (Device ID, time of access of the FREE NOW Driver App, browser type and operating system), information regarding the Transportation Company (for Drivers who are employees), company address (for Drivers who are, at the same time, sole proprietors), statements regarding ratings by Passengers (1 to 5 stars for the Driver and the vehicle as well as the average rating), license plate number, color and make of the vehicle, readiness status, user ID, number of Journeys, revenue, rate of concluding or breaking off Journeys, statements regarding payment by the Passenger including tips and, in encrypted form, the password you have selected, profile picture.
If you have registered with the FREE NOW Driver App, but have not completed the Driver on-boarding process, we may contact you using the email address and phone number that you provided during the registration process to remind you that the on-boarding is not yet complete. We rely on our legitimate interests [(Art. 6 (1) f) GDPR)] in resourcing our business to carry out this processing.
You can consent to the usage of your GPS coordinates by FREE NOW during the installation of the FREE NOW Driver App. Via the operating system of your end user device (smartphone, tablet, etc.), you can also consent to the usage of your GPS coordinates by FREE NOW at a later point in time or withdraw your consent. In the absence of you sharing your GPS coordinates with us, we cannot procure Journeys for you or, as it may be, for your Transportation Company, since we communicate Passenger requests based on location in order to arrive at a short time delay until arrival.
For purposes of identification, we show your GPS coordinates as well as your name and, insofar as it has been provided to us, your profile picture and the license plate number to the Passenger who has booked a Journey with you. After accepting the Journey, during the Journey and for a certain period of time after the conclusion of the Journey, the Passenger is able to call you via the FREE NOW Passenger App. For this, we are using a phone number masking service (see point 3.1.2). In this way the Passenger can still call you after a Journey in order to ask, for example, about items forgotten in the vehicle but is not able to see your phone number at any time.
Without the processing of the foregoing personal data, we cannot procure any Journeys for you through your Transportation Company. This does not apply to optional inputs.
When passengers book a tour in your area, we display your picture, name and average rating while arranging the tour. The passenger has no possibility to prefer a specific driver based on this information. The processing is based on the legitimate interest to present the tour arrangement process to the passenger in a more personalised and transparent way. You can object to this process using the contact information provided here, so that your information will not be displayed in such a case.
3.1.2. Multi-factor authentication and phone number masking via Twilio
For security reasons, when you register for the first time or log in from a new mobile device in the FREE NOW Driver App, we verify your registration with a code via SMS or email ("multi-factor authentication"). We use the service provider Twilio Inc. 375 Beale St, Suite 300 San Francisco, CA 94105, USA ("Twilio") to send the SMS. In order to best protect your data, we also use Twilio's calling service to mask your phone number to the relevant passenger. The passenger will still be able to call you (via Twilio) but will not know your phone number.
We have entered into a data processing agreement with Twilio to ensure that your personal data will only be processed in accordance with our instructions and with applicable data protection law. The lawfulness of the data transfer to the USA is ensured by Twilios' binding corporate rules according to Art. 47 GDPR. Additionally, we have entered into standard contractual clauses (SCCs) with Twilio.

3.1.3. Contact with FREE NOW
FREE NOW provides several means of contact for its customers such as our online contact form: https://driver.free-now.com/hc/it/requests/new. You can further contact FREE NOW per letter or phone. Whenever you get in touch with FREE NOW, we store and process your personal data.
Depending on the means of contact you chose, FREE NOW is processing the following of your personal data:
name, e-mail address, country, phone number, voice recordings, content of your messages, attachments
Legal basis for this processing generally is our legitimate interest, according to Art. 6 (1) f) GDPR, in responding to your messages. When you initiate a contact in order to enter into a contract or because of a contract with FREE NOW, the legal basis is Art. 6 (1) b) GDPR.
To use our online form you are only required to provide us with your e-mail address for us to respond to your message. Communication with FREE NOW is deleted after 3 years, based on our legitimate interest, Art. 6 (1) f) GDPR, for the establishment, exercise or defence of legal claims.
When calling FREE NOW your phone call may be recorded, based on our legitimate interest in improving our customer service quality, training our agents and verifying call contents. Call recordings get automatically deleted after 90 days. You can object to the processing of your personal data, please contact us at https://driver.free-now.com/hc/it/requests/new or or send a formless letter to the address given at the top.
In order to offer our best service to you, we are working together with Zendesk, Inc. 1019 Market Street, San Francisco, CA 94103, US. The transmission of your personal data is secured by Standard Contractual Clauses and Binding Corporate Rules in accordance with Art. 46 GDPR

3.1.4. Integration of Google Maps
The FREE NOW Driver App uses the Google Maps API which is provided by Google Ireland Limited Gordon House, Barrow Street Dublin 4 (“Google”). In this way, you can be shown maps in the FREE NOW Driver App and you can also have the ability to interact with said maps. Without the Google Maps API application, FREE NOW Driver App will not function. The terms of use for Google Maps can be found at: https://www.google.com/help/terms_maps.html. There, you will also find a notice regarding the privacy policy of Google: https://policies.google.com/privacy?hl=de. We use Google Maps in order to calculate the anticipated cost of the Journey and in order to interactively show you the distance to the Passenger who booked the Journey. We process your GPS coordinates in accordance with Art. 6 (1) f) GDPR, if you have agreed to the usage. Your GPS coordinates will only be transmitted to Google in an anonymized manner. An identification of your person is impossible.
3.1.5. Partnership with third party providers
FREENOW also uses third party providers to offer our services. If a passenger requests a trip through a third party, then your personal data (such as name, photograph, car registration number and license number) can be shared with that provider, solely in order to share this information with a passenger that requested the trip.
3.2. Payment
In order to make it possible to conduct payment pursuant to the respectively applicable “mytaxi Procurement Framework Agreement” or, as it may be, “FREE NOW Procurement Framework Agreement” and the respectively valid “Terms and Conditions for Taxi Companies”, the following personal data will be processed pursuant to Art. 6 (1) b) GDPR for the purpose of performance of the contract:
Your first name and surname, the number of Journeys, revenue and, if you are yourself a Transportation Company, information regarding payments and bank account.
3.3. Rating of Drivers and Passengers
Via the FREE NOW Passenger App, Passengers can rate you and your vehicle after a Journey with between 1 to 5 stars. The individual rating flows into the average value which we have determined for you and your vehicle. The individual rating is only visible to the respective Passenger who provides it, to you as the Driver and to FREE NOW. For Drivers who are employed with a Transportation Company, we only transmit the individual rating to your Transportation Company with your consent.
Further, Passengers can add Drivers as favorite Drivers in their FREE NOW Passenger App profiles. In this context, your first name and surname, your rating and the profile picture will be saved in the FREE NOW Passenger App of the respective Passenger.
The processing of this data takes place on the basis of our legitimate interest pursuant to Art. 6 (1) f) GDPR to ensure a reasonable standard of quality and ensure Passenger security.
Beyond this, you have the possibility of rating Passengers. The ratings are only visible to FREE NOW and will only be transmitted to the affected Passenger upon request in an anonymized form. The processing of personal data by FREE NOW will take place on the basis of your consent pursuant to Art. 6 (1) a) GDPR which you have given by providing a rating.
3.4. Fraud Prevention
3.4.1 Fraud-Scoring
FREE NOW is invested to make its platform a secure space for passengers and drivers. Therefore, FREE NOW has implemented measures to detect and prohibit fraudulent behaviour in order to protect passengers and drivers. Also, FREE NOW wants to reduce the risk of financial damages due to fraudulent behaviour. For this reason FREE NOW will conduct an evaluation of risk for fraudulent behaviour on the basis of a mathematical-statistical model (scoring). This processing is based on the abovementioned legitimate interest pursuant to Art. 6 (1) f) GDPR.
To determine the score, the following personal data will be processed:
Passenger and Driver data such as: phone number, email address, name, device identifiers,
Tour data such as: length of the tour, distance to the passenger, used incentives, tour value, starting location and destination location,
Payment data such as: payment method.
The values stemming from this data are compared to a set of previously defined scenarios that indicate fraudulent behaviour. Based on the number of scenarios that we identify, our European fraud prevention service provider will calculate a score revealing the likelihood of fraudulent behaviour. Based on that score a specially trained FREE NOW employee will further investigate if there can be any confirmation of fraudulent behaviour. The score will not be used for any automated decision-making. Any actions taken will never be justified by the score and will always involve human oversight.
3.4.2 Tour Fraud Prevention
In order to prevent fraudulent activity, we store your GPS location data sent to us by your mobile device at short intervals from the time of acceptance until the end of a tour. This allows FREE NOW to create a map of the entire course of a tour. In this way, we want to ensure that drivers do not deliberately extend the route in order to achieve a higher fee. At the same time, we can rectify unjustified passenger complaints by being able to follow the actual course and route to a tour. The processing of your GPS location data during a tour takes place for your own protection, as well as for the protection of the passenger and for our protection on the basis of Art. 6 (1) f) GDPR.
3.5. Bug Fixing and Functionality Improvements
In order to fix bugs in the FREE NOW Driver App and to improve functionality of the FREE NOW Driver App and to adjust it to suit the needs of Drivers, we process the following personal data pursuant to Art. 6 (1) f) GDPR on the basis of our legitimate interest:
First name and surname, date of birth, city, country, e-mail address, fax number, mobile phone number, information regarding your license, your GPS coordinates while being logged into the FREE NOW Driver App and at the time of booking, time of starting and during the course and at the destination of a particular Journey, information regarding your end user device (Device ID, time of access of the FREE NOW Driver App, browser type and operating system), information regarding the Transportation Company (for Drivers who are not themselves Transport Companies), company address (for Drivers who are, at the same time, Transportation Companies), information regarding the rating of Passengers (1 to 5 stars for the Driver and the vehicle as well as the average rating), license plate, color and make of the vehicle, readiness status, user ID, number of Journeys, revenue, rate of concluding or breaking off Journeys, statements regarding payment by the Passenger including tips and, in encrypted form, the password you have selected.
Inasmuch as it is sufficient for the performance of the respective purpose, we work with anonymous data and not with personal data.
To improve our response time to errors within the FREE NOW app and to improve the performance of our app, we work with the service provider DataDog Inc, New York Times Bldg, 620 8th Ave, Fl 45, New York, NY 10018, USA. All data processed by Datadog is automatically deleted after a maximum of 30 days.
Transfers of personal data to Apptimize and Datadog are secured by standard contractual clauses according to Art. 46 GDPR, providing an adequate level of data protection.

3.6. News & Personalized Offers
3.6.1. General
When you provide FREE NOW the permission to send push notifications during FREE NOW Driver App installation, FREE NOW will send you push notifications based on your provided consent. This consent is overridden if, in the context of the registration process or later in the profile of the FREE NOW Driver App under the rubric “Privacy“, consent is given to receive news & personalized offers (advertising, coupons and special offers) and to show usage-based advertising („Retargeting“), and the correspondingly placed toggle has been activated, you will receive offers and advertising from us, and also for products and services of other companies of the FREE NOW Group. In this respect, your end user device (smartphone, tablet, PC, etc.) will receive personalized advertisements via electronic post (e-mail, SMS, MMS) or by another electronic means (via in-app messages, push messages).
In connection with this, we process the following personal data pursuant to Art. 6 (1) a) GDPR, insofar as you have given us the corresponding consent:
First name and surname, driver ID, e-mail address, business address, mobile phone number, profile picture (optional input), registration data, language setting, type of Journey (booking, try-out ride), version of the FREE NOW Driver App, login information, your GPS location data at the time of the booking and at the time of the end of the Journey or, as it may be, the pickup and destination locations, device ID (device identifier), IDFA (advertising identifier Apple Identifier for Advertisers), IFV (advertising identifier, Identifier Vendor), GAID (Google Advertising Identifier), IP address and usage data (usage frequency, information relating to the downloading of the FREE NOW Driver App, status of the registration of Journeys), language, time zone and city.
If you do not wish to receive the foregoing stated news & personalized offers, you can – just as easily as you consented – withdraw your consent by activating the corresponding toggle. Please note that the withdrawal and ensuing changes are valid only for the future and will be effective or, as it may be, implemented by no later than 48 hours from withdrawal. This is for reasons of a technical nature, which do not permit faster implementation.
3.6.2. Direct Advertising for Existing Customers
If, in connection with the performance of our procurement services, we have received your e-mail address or mobile phone number and you have completed at least one Journey which we procured, we will use these exclusively for our own direct advertising of our own products and services via electronic post (e-mail, SMS and MMS), unless you have rejected such direct advertising. To this purpose, on the basis of our legitimate interest pursuant to Art. 6 (1) f) GDPR, we process the following data: e-mail address and mobile phone number. Our legitimate interest lies in intensifying customer relationships by proposing appropriate and interesting product information. The objection to direct advertising is possible at any time with effect for the future by clicking on the corresponding link in a relevant e-mail (e.g. to unsubscribe to a newsletter) or by contact via SMS. The direct advertisement sent by us is not personalized. Please take into account that the objection and the modifications required thereby are valid only for the future and will be effective or, as it may be, implemented by no later than 48 hours from withdrawal. This is for reasons of a technical nature, which do not permit faster implementation.
3.6.3. Usage of the AppsFlyer Technology
We use the services of the provider AppsFlyer Ltd., 14 Maskit St., Herzliya, Israel ("AppsFlyer") to learn in which ways Drivers become aware of our App and use it. In this context, certain information is collected, processed and used regarding the devices used by the Drivers, their online usage behavior and the contents of websites they visit. In particular, this includes information regarding:
AppsFlyer uses these data on our behalf to evaluate and analyze the performance of our marketing measures and channels and to determine how Drivers respond to specific campaigns, how they use the app and interact with it. The foregoing described data is not used to individualize individual users or to associate them with a specific person. Additionally, the data are used to uncover and prevent cases of so called “mobile fraud“, i.e. manipulating and fraudulent actions in connection with our marketing measures. On the basis of the collected data which are aggregated in the course of the process, AppsFlyer can identify for us if certain actions relating to our app (e.g. download or installation) were caused by manipulation. This also serves our business interests as we have to consider such mobile fraud actions in the compensation of our cooperating partners (advertising networks/partner websites which display our advertisements). Further information regarding the treatment of your data by AppsFlyer can be reviewed at https://www.appsflyer.com/services-privacy-policy. The data processing occurs, therefore, on the basis of the so called balancing of interests clause in Art. 6 (1). (f) GDPR and in the context of our foregoing described legitimate interest.

3.6.4. Sending news and service communications
For sending news, service communication and advertising e-mails, SMS and in-app messages, we make use of the service provider Braze Inc., 330 West 34th Street, New York, NY 10001, USA (“Braze”). For sending service communications, we make use of the service provider “MailChimp“, which is operated by Rocket Science Group, LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.
The personal data processed includes
We have concluded data processing agreements with our service providers which ensures that the service provider exclusively processes your personal data pursuant to our instructions and in accordance with current data protection law.
We have concluded standard contractual clauses (SCCs) with Braze and Mailchimp in accordance with Art. 46 GDPR to ensure an adequate level of data protection when processing your data.
The legal basis for the transmission of data and its processing by our service providers is Art. 6 (1) f) GDPR in connection with Art. 28 GDPR. Our legitimate interest in the engaging of these service providers lies in the professional and reasonable organization of automated processes in an economically sensible way which makes it possible to provide you a positive user experience.

3.6.5. Facebook Custom Audiences
In order to be able to display individually targeted advertisements about our services within the Facebook social network, a service of Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (“Facebook”), and on Facebook partner sites, we work with Facebook Custom Audiences. We do this so that advertisements (e.g. banners) can be tailored exactly to the possible needs of the customer. The basis of this is a marking process. In this context, the so called advertising identifier (IDFA or GAID) from the customer’s end user device (e.g. smartphone) is sent automatically or manually, using a service provider selected by FREE NOW, to Facebook via a certain interface. The advertising identifiers are individual, but not personalized and not permanent identification numbers for a certain end user device which are provided by iOS or, as it may be, Android. You can prevent the transmission of advertising identifiers if, in iOS under “Settings” – “Data Protection” – “Advertising”, you select the option “no ad tracking” or, as it may be, for Android, under “Settings” – “Google” – “Advertising” select the option “deactivate personalized advertising.” Further, you have the option to delete the advertising identifier at any time in the device settings (iOS: “Reset Ad-ID”; Android: “Reset Advertising-ID”). Then, a new identification number will be generated for your device which will not be aggregated with the previously obtained data for your device. After the transmission of the advertising identifiers, FREE NOW will prepare a list of customers who have performed certain actions using the FREE NOW Driver App. In this context, certain pre-defined actions can be selected (e.g. installation of the FREE NOW Driver App in the previous 30 days). Facebook compares the advertising identifier of the customer with the advertising identifier of individuals with a Facebook profile, defines certain groups (e.g. Group 1: Installation in the previous 30 days) and then shows appropriate ads to this group. Facebook can also use the data to select other Facebook users whose statistical behaviors are similar to those of our customers or app users (so called statistical twins, called Lookalike Audience by Facebook). In this way, our advertising can reach individuals who are not yet using our services but who, with a high likelihood, would be interested in doing so. Customers who are not, at the same time, Facebook users, cannot however be compared by Facebook and they are not shown any advertisements. Furthermore, conditioned upon your consent, we can manually transmit your e-mail address in an encrypted form to Facebook (so called hash procedure). Facebook then compares whether the transmitted e-mail address corresponds with existing Facebook customers. If there is a correspondence, then these target groups will be shown targeted advertisements/campaigns by FREE NOW on Facebook or on partner websites of Facebook. In connection with Facebook Custom Audiences, we process the following data pursuant to Art. 6 (1) a) GDPR: web identifier (IDFA for Apple or GAID for Google) and the e-mail address.
If you no longer wish for your data to be processed in connection with Facebook Custom Audiences, you can – just as easily as when you gave consent – withdraw your consent in the “Data Protection Settings“ of the FREE NOW Driver App *(under the option “Profile“) by turning off the toggle relating to “Personalized Advertising”. Please note that the withdrawal and the thereupon ensuing changes are valid for the future and will be effective or, as it may be, implemented by no later than 48 hours from the withdrawal. This is for reasons of a technical nature, which do not permit faster implementation.
3.6.6. Mobile Attribution Tracking
We make use of the service providers Pinterest (Pinterest Europe Ltd, Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland; "Pinterest"), Snapchat (Snap Group Ltd, 77 Shaftesbury Avenue, London, W1D 5DU, United Kingdom; "Snapchat"), Twitter (Twitter International Company, One Cumberland Place, Fenian Street, Dublin 2, D02 AX07, Ireland; "Twitter") and AdTriba (AdTriba GmbH, Beim Schlump 13a, 20144 Hamburg, Germany; „AdTriba“) to deploy marketing campaigns according to demand, further optimize them and measure their reach. The following data are processed:
Device information (e.g. type, brand), Advertising Identifiers (IDFA), operating system used, IP address, timestamp of the call to our offer, type and content of the campaign and the click behaviour in relation to a campaign.

3.7. Studies & Surveys
3.7.1. General Information
If you have consented in the course of the registration process or, later, in the profile of the FREE NOW Driver App under “Data Protection“, to receive studies & surveys, and have activated the corresponding toggle, we will contact you after a Journey or at some other time in the context of personalized (sent only to you and based on an analysis of the FREE NOW Driver App usage frequency) studies & surveys sent by electronic post (e-mail, SMS, MMS) or otherwise electronically (in-app messages, push messages) and request your participation. For example, we carry out quest campaigns at regular intervals, with the help of which we aim to increase and optimise the tours we arrange. In studies and surveys, the following personal data may be processed by us in accordance with Art. 6 (1) a) GDPR:
First name and surname, Driver ID, e-mail address, business address, mobile phone number, profile picture (optional input), method of payment, registration data, language set, FREE NOW Driver App profile (business or private customer), type of Journey (booking, try-out ride), FREE NOW Driver App version, login information (user name), your GPS coordinates at the time of booking and at the end of the Journey and usage data (usage frequency, information regarding the download of the FREE NOW Driver App, status of registrations or Journey), registration data, date of last login, push tokens, Device ID (device identifier), IDFA (advertising identifier, Apple Identifier for Advertisers), IFV (advertising identifier, Identifier Vendor), GAID (Google Advertising Identifier) and IP address

In order to increase the ease of scheduling appointments we use the service provided by Calendly, LLC, 271 17th St NW, 10th Floor, Atlanta, Georgia 30363, US. Calendly is a global provider of a platform that facilitates scheduling of appointments and therefore processes your personal information. Calendly assures that they do not store who the user is meeting with, their e-mail, the meeting title or any other details about the appointments. Respective to the data you voluntarily provide, the following data can be processed:

calendar information like calendar availability, subject of the meeting, date and time of a meeting

Calendly guarantees that the processing of personal data is subject to an adequate protection level, in that the requirements of European data protection law are adhered to. FREE NOW has conducted a risk assessment for this transfer of personal data into a third country and deems the level of data protection as adequate, with regard to the implemented security measures. In addition, we have concluded standard contractual clauses (SCCs) with Calendly in accordance with Art. 46 GDPR to ensure an adequate level of data protection.
3.8. Social Media Presences
3.8.1. Facebook
When entering our Facebook-page (via a link on our website, in our newsletter or directly) you reach the technical platform provided by Facebook Ireland Ltd., 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland („Facebook“). We would like to inform you that you use the Facebook-page and its functions on your own responsibility. This especially applies for the use of the interactive functions (e.g. comments, sharing, rating). During you visit on our Facebook-page, FREE NOW basically processes personal data only if you interact with us via the page, e.g. when leaving a comment, press a like-button or sending us a message. The revocation does not affect the legitimate consent-based processing that was performed until the revocation.
Additionally, we analyze the visits and interactions on our page. For this Facebook creates usage profiles and provides the data in form of page-insights (“page-insights”). We process personal data on our social media pages as far as the user interacts with us directly, by commenting or liking our posts or sending messages. Legal basis for this kind processing is the user‘s consent according to Art. 6 (1) a) GDPR or in case of contract-related requests Art. 6 (1) b) GDPR. As the case may be, we share content on our social media page, if this is a function of the social media platform and communicate with you via this platform. Art. 6 (1) f) GDPR builds the legal basis for this. The processing is performed due to a legitimate interest in public relations and communications.
4. Data Exchange within the FREE NOW Group
For internal administration and standardization purposes, we may transfer personal data of drivers or passengers within the FREE NOW Group. The legal basis for this is our legitimate interest in effective company management, Art. 6 (1) f) GDPR, see also Recital 48 to the GDPR.
4.1. Joint Controller Agreement
FREE NOW has entered into a Joint Controller Agreement according to Art. 26 GDPR with Intelligent Apps GmbH, Neumühlen 19, 22763 Hamburg, Germany (“Intelligent Apps”). The Parties have jointly determined the order of the processing of your personal data in each section of processing.
The purpose of this agreement is to unify the handling of driver data and billing across the entire FREE NOW Group. The Parties jointly agreed on which obligations each party fulfils under the GDPR.
Intelligent Apps GmbH is processing jointly the drivers’ personal data of FREE NOW to improve the software of the FREE NOW Driver application and provide technical know-how to FREE NOW. FREE NOW is responsible for all data processing with regard to the local usage of the FREE NOW Driver application.
Despite the existence of a joint controllership, the Parties fulfil the obligations under data protection law in accordance with their respective competences. The Parties shall provide any information referred to in Articles 13 and 14 GDPR to you free of charge in a concise, transparent, intelligible and easily accessible form, using clear and plain language. For this purpose, each Party shall provide the other Party with all necessary information relating to their respective operating range. The Parties shall immediately inform each other about the exertion of your rights and provide the other Party with all necessary information referred to the right of access. Pursuant to Articles 15 through 22 GDPR, you may exercise your rights under the GDPR in respect of and against each of the Parties. 5. Processing in-/outside of the European Union / European Economic Area
In part, we arrange for external service providers to process your data (e.g. troubleshooting, creation of mailings). To this end it is necessary for us to transmit your personal data to our external service providers for a specified purpose (confined to the purpose in question). We have selected our service providers carefully and engaged them in writing. They are bound by our instructions and we have obtained information about their technical and organizational measures for the secure processing of personal data. We also require that our service providers comply with the applicable data protection regulations. We work with service providers from the EU and EEA countries. We have concluded data processing agreements with our external service providers in accordance with Art. 28 (3) GDPR, inasmuch as this is required for the contractual purpose. The transfer to service providers outside of the European Economic Area takes place correspondingly on the basis of decisions by the EU Commission pursuant to Art. 45 GDPR or on the basis of standard EU contractual clauses.
In the event of the United Kingdom's unregulated withdrawal from the European Union ("hard brexit"), through which the UK would at least temporarily become a third country in terms of data protection, we have concluded standard contractual clauses (SCCs) with our UK location to ensure the consistent legality of data transfers.
We store all our data with a cloud service provider within the EU or in IT infrastructures and systems (employee computers) at our sites within the EU.
However, we do reserve the right to disclose information about you if we are legally obligated to do so or if we are asked to surrender it by administrative or law enforcement bodies (e.g. police or state prosecutors).
6. Your Rights
You have the right to obtain confirmation as to whether or not personal data concerning you is being processed by us. Where this is the case, we will be pleased to give you access to the personal data and the information listed in Art. 15 GDPR.
In addition, you have the right to rectification (Art. 16 GDPR), the right to erasure (Art. 17 GDPR), the right to restriction of processing (Art. 18 GDPR) and the right to data portability (Art. 20 GDPR), subject to the relevant legal requirements. In addition, you have the right to object to the processing under the statutory conditions (Art. 21 GDPR) or to withdraw any consent you have given at any time with effect for the future (Art. 7 (3) GDPR).

We have taken appropriate technical and organizational measures to guarantee data security, in particular to protect your personal data against access by third parties, as well as accidental or intentional modification, loss or destruction. Such measures are reviewed periodically and adapted in line with the state of the art. The transfer of your personal data from your end user device (e.g. smartphone) to us is always encrypted. FREE NOW is PCI DSS (Payment Card Industry Data Security Standard) certified.
8. Storage Period
The data provided by you to us is only stored for as long as is required to perform the respective purpose for which you have transmitted your data, or inasmuch as it is required for conformity with statutory or official requirements. personal data is anonymized by us, in principle, after three years, unless we have a legitimate interest in a longer storage period (e.g. bookkeeping requirements).
9. Updates and Changes
We retain the right to modify this privacy policy at any time in the future in accordance with the applicable data protection regulations.
