Preliminary Remarks, Note

These redeeming conditions apply whenever, with reference to these redeeming conditions, vouchers are announced or issued to you (“you” also being the “User” in the meaning of these redemption terms). These redeeming conditions apply in conjunction with any special conditions for the respective promotion campaign or the respective occasion on which vouchers are issued. The specific conditions will be announced to you as part of the voucher announcement or issuance of the voucher and would particularly concern information on the specific voucher value, the service type, the validity period and certain conditions for the receipt of the voucher (e.g. issuance only to "first time pay by app" users, in the context of referral programs, goodwill vouchers, competitions, collectors’ campaigns).

Note: For the use of the/FREE NOW-App including its "Pay by App" feature (hereinafter “the App”), the local operator’s terms and conditions for passengers apply in the version currently valid in your selected country. 

In the case of passenger transportation, neither the Issuer of the vouchers nor its affiliated operating companies in the participating countries are parties to the passenger transport contract between the passenger and the transportation company as the Issuer or its affiliates, respectively, only act as an intermediary of such contracts. 

In case of applicable tariff regulations, the Transport Operator will always receive the full fare according to the applicable tariff of the regional regulation.

1. Issuer 

The Issuer of the vouchers is mytaxi Iberia SL. (hereinafter referred to as "Issuer").

2. Content of the voucher, validity, regional scope

(1) Within the scope of these redeeming conditions, the Issuer gives each of the App users, who are eligible according to section 3. below, the opportunity to redeem the respective voucher for the Covered Service Type (i) only within the specified validity period or in the context of the respective promotion campaign, (ii) exclusively in case of cashless payment by App and (iii) within the territorial scope defined in section 2.(3) below.

(2) The redemption is limited to the maximum amount of the stipulated voucher value. Even in the case of a voucher issued in the form of a percentage share in the costs of the ride, the voucher value may be limited to a maximum amount, the amount of which will be announced to you when the respective voucher is issued. If the costs incurred for a ride exceed the value of your respective voucher, the difference must be paid by you. The voucher will not cover the fees that FREE NOW may charge from time to time. 

(3) A voucher may also be limited to a maximum number of uses (hereinafter referred to as the “Redemption Limit”), previously decided by the Issuer. Once the Redemption Limit is reached, the voucher will be automatically deactivated. In case the User had deposited the voucher, but had not redeemed it before the Redemption Limit was reached, they will not be able to use the voucher. The User will receive a message informing them that the voucher redemption limit has been reached.
 

(4) The redemption is possible within the announced validity period and only in selected areas in which the FREE NOW intermediation service is available.

The vouchers under these redeeming conditions will be issued as an individual voucher code per each selected country. The individual voucher code is redeemable only in that designated country.

In the case of passenger transportation via taxi, a voucher may only be redeemed for a taxi ride that starts and ends in one of the cities within the Territorial Scope mentioned above, whereby the area of application of the taxi / taxi tariff regulations valid for the respective city must not be left during the taxi ride.

3. Eligibility

(1) If a voucher is issued for the first payment by App, it can only be redeemed in case where at the time of redeeming the voucher, the User has never paid for a ride using Pay by App. If on the first Pay by App trip, the User has not redeemed the voucher, the voucher expires, and the User will not be able to take advantage of the voucher for the first payment by App for any later Pay by App trip.  

(2) The redemption of any voucher issued under these redeeming conditions requires that the User has previously downloaded the App from the Appstore available on his smartphone (Android or iOS), installed it on his smartphone, has registered for free with the App by providing the information required for registration purposes (especially first and last name, Phone number, valid email address, secure password) and thereby accepting the terms and conditions for passengers applicable in the respective country. The User must then register an available payment method for Pay by App purposes depending on the country of use (e.g. credit or debit card, PayPal, Apple Pay, Google Pay). 

(3) Any natural person of the age of 18 or older is entitled to participate and redeem the voucher. Our business customers, our Business Account customers and their respective employees who have been given the authorization to use the App for the payment of business trips are not eligible to participate in the respective voucher promotion and may particularly not redeem the voucher upon paying a business trip via the App.

(4) The redemption is limited to the maximum amount of the stipulated voucher value. Even in case of a voucher issued in the form of a percentage share in the costs of the ride, the voucher value may be limited to a maximum amount, the amount of which will be announced to you when the respective voucher is issued. If the costs incurred for a ride exceed the value of your respective voucher, the difference must be paid by you. 

(5) Redemption is only permitted once within the stipulated validity period. A redemption past the validity period is excluded.

(6) The voucher and its respective voucher value expire once it has been used. Reusing your voucher is not possible. An expired voucher lapses without replacement. A cash payout of vouchers or of any voucher credit is excluded.

(7) The Issuer, or the affiliated operating company in the country where the voucher is redeemed, may in its absolute discretion block and/or delete the user’s account if it has reasonable grounds for suspecting that the User has used a Voucher in breach of these redeeming conditions, unlawfully, fraudulently or in bad faith. The Issuer, or the affiliated operating company in the country where the voucher is redeemed, will have the right to ask the User for reimbursement of any value or service that has been gained fraudulently.

4. Redemption

(1) As soon as you have registered as a User of the App and have activated the Pay by App feature (see above section 3 (2) for details), in order to redeem the voucher, you must deposit the voucher which will be announced to you in the form of a corresponding voucher code in the App. 

(2) If within the validity period and Territorial Scope of your voucher you (i) order a ride with the App, complete the tour and pay by App or (ii) in case of a so-called hop on tour using a taxi, in which case the taxi was not ordered with the App, you complete the tour and pay by App, no payment is required up to the voucher value shown on the voucher that you have previously deposited. If the bill exceeds the voucher value, the difference must be paid by you via the App.

(3) If you use a voucher in accordance with these redeeming conditions for passenger transportation via taxi, the gross transport fare will continue to be based on the valid taxi fare of the local taxi regulations applicable in the respective area of validity. The taxi operator will receive the full taxi fare (plus any tip you have chosen to give and plus applicable VAT). When using a valid voucher for passenger transportation via taxi, the Issuer will take over from your taxi bill the amount resulting from the value of the voucher.

(4) Vouchers cannot be combined with other offers, subsidies, vouchers or discounts. The vouchers have no cash value, are non-transferable and can only be redeemed once. The voucher can only be redeemed by entering the respective voucher code. There is no substitute for lost or stolen vouchers. The voucher cannot be sold, resold or redeemed for cash.

5. Miscellaneous 

(1) Should individual provisions of these redeeming conditions be or become invalid, the validity of the remaining conditions shall remain unaffected. The invalid provision shall be replaced by a provision that best approximates the intent of the invalid provision. 

(2) These redeeming conditions may be amended by the Issuer, provided that the present conditions contain gaps (additions) or where subsequent factual or legal disruptions arise that may materially impair or render impossible the purpose of the respective promotional campaign under these redeeming conditions.

(3) These redeeming conditions are subject to the laws of Spain. If you are a consumer and have a habitual residence in the EU, you additionally enjoy the protection afforded by mandatory provisions of the law of your country of residence.

Observaciones preliminares

Estas condiciones de canje se aplican siempre que, en relación con estas condiciones de canje, se anuncien o emitan cupones a tu nombre («tú», que también eres el «Usuario/a» en el sentido de estas condiciones de canje). Estas condiciones de canje se aplican junto con las condiciones especiales de la campaña de promoción correspondiente o en la ocasión determinada en la que se emitan los cupones. Las condiciones específicas se anunciarán en el marco del anuncio del cupón o de la emisión del cupón y se referirán especialmente a la información sobre el valor específico del cupón, el tipo de servicio, el período de validez y ciertas condiciones para la recepción del cupón (por ejemplo, la emisión únicamente a usuarios que «pagan por primera vez a través de la aplicación», en el contexto de programas de recomendación, cupones, concursos y campañas de promocionales).

Nota: En lo referente al uso de la app de FREE NOW, incluida la función «Pago vía App» (en lo sucesivo, la «App»), se aplicarán las Condiciones Generales para Pasajeros en la versión actualmente válida en el país seleccionado.

En el caso del transporte de pasajeros, ni el Emisor de los cupones ni sus filiales operativas en los países participantes son partes del contrato de transporte de pasajeros entre el pasajero y la empresa de transporte, ya que el Emisor o sus filiales, respectivamente, solo actúan como intermediarios de dichos contratos.

En caso de que tarifas reglamentarias sean aplicables, el Transportista recibirá siempre la tarifa completa de acuerdo con la tarifa aplicable de acuerdo con la normativa regional.

1. Emisor

El Emisor de los cupones es mytaxi Iberia SL. (en adelante, el «Emisor»).

2. Contenido del cupón, validez, ámbito regional

(1) Dentro del alcance de estas condiciones de canje, el Emisor ofrece a cada uno de los usuarios de la App que cumplan los requisitos establecidos en la sección 3 a continuación, la oportunidad de canjear el cupón correspondiente por el Tipo de servicio cubierto (i) solo dentro del período de validez especificado o en el contexto de la campaña de promoción correspondiente, (ii) exclusivamente en caso de pago sin efectivo a través de la App y (iii) en el ámbito territorial definido en el apartado 2.(3) abajo.

(2) El canje se limita al importe máximo del valor del cupón estipulado. Incluso en el caso de un cupón emitido en forma de porcentaje de descuento sobre el coste del viaje, el valor del cupón puede estar limitado a un monto máximo, cuyo monto se le informará cuando se emita el cupón respectivo. Si los costos incurridos por un viaje exceden el valor máximo del cupón respectivo, usted debe pagar la diferencia. El cupón no cubrirá las tarifas que FREE NOW pueda cobrar al Usuario.

(3) Un cupón también podrá limitarse a un número máximo de usos (en adelante, el “Límite de Redención”), previamente decidido por el Emisor. Una vez que se alcance el Límite de Redención, el cupón se desactivará automáticamente. En caso de que el Usuario haya depositado el cupón, pero no lo haya canjeado antes de alcanzar el Límite de canje, no podrá utilizar el cupón una vez alcanzado dicho límite. El Usuario recibirá un mensaje informándole de que se ha alcanzado el límite de canje del cupón.

(4) El canje es posible dentro del periodo de validez anunciado y solo en determinadas áreas en las que esté disponible el servicio de intermediación de FREE NOW.

Los cupones en estas condiciones de canje se emitirán como un código de cupón individual por cada país seleccionado. El código de cupón individual solo se puede canjear en el país designado.

En el caso del transporte de pasajeros a través de taxi, solo se podrá canjear un cupón por un viaje en taxi que comience y termine en una de las ciudades del Ámbito Territorial mencionado anteriormente, por lo que el área de aplicación de los taxis/las normas de tarifas de taxis válidas para la ciudad respectiva deben respetarse durante el viaje en taxi.

3. Elegibilidad

(1) Si se emite un cupón para el primer pago a través de la App, solo se podrá canjear en el caso de que, en el momento de canjear el cupón, el Usuario nunca haya pagado un viaje utilizando Paga vía App. Si durante el primer viaje con Pago vía App, el usuario no ha canjeado el cupón, este caduca y no podrá ser utilizado en un viaje posterior con Pago vía App. 

(2) El canje de cualquier cupón emitido en virtud de estas condiciones de canje requiere que el Usuario haya descargado previamente la App de la Appstore disponible en su smartphone (Android o iOS), la haya instalado en su smartphone, se haya registrado de forma gratuita en la App proporcionando la información necesaria para fines de registro (especialmente nombre y apellido, número de teléfono, dirección de correo electrónico válida, contraseña segura) y haya aceptado los términos y condiciones para los pasajeros aplicables en el país correspondiente. A continuación, el usuario debe registrar un método de pago disponible para Pago vía App en función del país de uso (p. ej., tarjeta de crédito o débito, PayPal, Apple Pay, Google Pay).

(3) Toda persona física mayor de 18 años tiene derecho a participar y canjear cupones. Nuestros clientes de Cuentas de empresa y sus respectivos empleados/as que hayan seleccionado la cuenta de empresa para el Pago vía App no podrán participar en la promoción de cupones correspondiente y no podrán canjear el cupón al pagar un viaje con la cuenta de empresa a través de la App.

(4) El canje se limita al importe máximo del valor estipulado para el cupón. Incluso en el caso de un cupón emitido en forma de porcentaje de los costes del viaje, el valor del cupón puede limitarse a un importe máximo, cuyo importe será anunciado cuando se emita el cupón correspondiente. Si los costes incurridos en un viaje superan el valor de tu cupón, tendrás que pagar la diferencia.

(5) El canje solo se permite una vez dentro del período de validez estipulado. Se excluyen los canjes posteriores al periodo de validez.

(6) El cupón y su valor caducan una vez utilizado. No es posible reutilizar un cupón. Los cupones caducados caducan sin ser sustituidos. Queda excluido el pago en efectivo de cupones o de cualquier crédito de cupón.

(7) El Emisor, o la compañía operativa afiliada en el país donde se canjea el cupón, puede, a su entera discreción, bloquear y/o eliminar la cuenta del usuario si tiene motivos razonables para sospechar que el Usuario ha utilizado un cupón incumpliendo estas condiciones de canje, de forma ilegal, fraudulenta o de mala fe. El Emisor, o la compañía operativa afiliada del país en el que se canjea el cupón, tendrá derecho a solicitar al Usuario el reembolso de cualquier valor o servicio que se haya ganado de forma fraudulenta.

4. Canje

(1) En cuanto te hayas registrado como usuario de la App y hayas activado la función de Pago vía App (véase más arriba el apartado 3 (2) para obtener más información), para canjear el cupón deberás depositar el cupón que se te comunicará a través de la App en forma de código de cupón.

(2) Si dentro del período de validez y el Ámbito Territorial de tu cupón (i) pides un viaje con la App, completas el recorrido y pagas a través de la App o (ii) en caso de viaje en taxi, en cuyo caso el taxi no se haya pedido con la App, completas la excursión y pagas con la App, no se requerirá ningún pago hasta llegar al valor del cupón que se muestra en el cupón que hayas depositado previamente. Si la factura supera el valor del cupón, debes pagar la diferencia a través de la App.

(3) Si utilizas un cupón de acuerdo con estas condiciones de canje para el transporte de pasajeros a través de taxi, la tarifa bruta de transporte seguirá estando basada en la tarifa de taxi válida de la normativa local aplicable en el área de validez correspondiente. El taxista recibirá la tarifa de taxi completa (además de cualquier propina que hayas elegido dar y el IVA aplicable). Cuando utilices un cupón válido para el transporte de pasajeros en taxi, el Emisor restará de tu factura de taxi el importe resultante del valor del cupón.

(4) Los cupones no se pueden combinar con otras ofertas, subvenciones, cupones o descuentos. Los cupones no tienen valor en efectivo, no son transferibles y solo se pueden canjear una vez. El cupón solo se puede canjear introduciendo el código de cupón correspondiente. No hay nada que sustituya a los cupones perdidos o robados. El cupón no se puede vender, revender ni canjear por dinero en efectivo.

5. Otros

(1) Si alguna de las disposiciones de las presentes condiciones de canje fuese inválida o llegara a perder su validez, esto no afectará a la validez de las demás condiciones. La disposición inválida se sustituirá por la disposición que mejor se aproxime a la intención de la disposición inválida.

(2) Estas condiciones de canje podrán ser modificadas por el Emisor, siempre que las presentes condiciones contengan lagunas (adiciones) o cuando se produzcan alteraciones fácticas o legales posteriores que puedan perjudicar materialmente o imposibilitar el propósito de la campaña promocional respectiva en virtud de estas condiciones de canje.

(3) Estas condiciones de canje están sujetas a la legislación española. Si eres consumidor/a y tienes residencia habitual en la UE, disfrutarás además de la protección que ofrecen las disposiciones obligatorias de la legislación de tu país de residencia.
