We as Freenow (“Freenow“, “we“ or “us“) take data protection in general very seriously. In the following we will inform you about the personal data Freenow is processing and for what purpose we are processing your personal data when you apply for a job. Additionally, it explains your rights under the GDPR. 

This privacy policy (“Policy”) applies in addition to our standard privacy policy where you will find general information on data processing relating to your visit on our website and our Freenow app.

2. Definitions:

“Freenow Group“ consists of the aforementioned legal entities. 

“Personal Data“ are all information which relates to an identified or identifiable natural person. This includes, e.g., items like the name, postal address, e-mail address or telephone number, but also usage data like your IP address.

“Processing“ is every process carried out with or without automated assistance or every sequence of such processes in connection with personal data, e.g. obtaining, capturing, organising, ordering, saving, adjusting or modifying, sorting, accessing, using, disclosing by transmission, distributing or any other form of making available, comparing or connecting, limiting, deleting or destroying.

3. Categories of personal data we process:

This Policy covers the information you share with us and/or which may be acquired or produced by Freenow during the application or recruitment process including:

  • Your name, address, email address, telephone number and other contact information;

  • Your resume or CV, cover letter, previous and/or relevant work experience or other experience, education, transcripts, reference letters or other information you provide to us in support of an application and/or the application and recruitment process;

  • Information from interviews and phone-screenings you may have, if any;

  • Details of the type of employment you are or may be looking for, current and/or desired salary and other terms relating to compensation and benefits packages, willingness to relocate, or other job preferences;

  • Details of how you heard about the position you are applying for;

  • Any sensitive and/or demographic information processed during the application or recruitment process such as gender, medical or health information and/or your racial or ethnic origin (voluntary);

  • Information about your citizenship and/or nationality in case you need a visa sponsorship or to assess your eligibility to work in a chosen location; 

  • Information relating to any previous applications you may have made to Freenow and/or any previous employment history with Freenow;

  • Your information from publicly available sources, including online, that we believe is relevant to your application or a potential future application (e.g. your LinkedIn profile); and/or

  • Information related to any assessment you may take as part of the interview screening process.

 

4. How do we use the data we collect:

Your information will be used by Freenow for the purposes of carrying out our application and recruitment process which includes:

  • Assessing your skills, qualifications and interests against our career opportunities;

  • Communications with you about the recruitment process and/or your application(s),

  • Where requested by you, assisting you with obtaining an immigration visa or work permit where required;

  • Making improvements to Freenow’s application and/or recruitment process including improving diversity in recruitment practices;

  • Complying with applicable laws, regulations, legal processes or enforceable governmental requests; and/or

  • Proactively conducting research about your educational and professional background and skills and contacting you if we think you would be suitable for a role with us.

As part of our recruitment process, we use an AI-assisted tool to support the initial screening of applications. This tool analyses your CV and application responses against predefined job criteria and provides a structured recommendation to our Talent Acquisition team. There is no automated decision making, as all the final decisions are made by a human recruiter.

5. Legal basis:

We collect and process your information where it is necessary in order to take steps, at your request, prior to potentially entering into a contract of employment with you (Art. 6 (1) (b) GDPR).

We may also seek your consent (Art. 6 (1) (a) GDPR) to process your personal information in specific circumstances (e.g. including you in our potential talent pool), or process it where necessary to comply with a legal obligation or for purposes connected to legal claims (Art. 6 (1) (c) GDPR). If we use your information to improve our application or recruitment process, we do so on the basis that it is in our legitimate interests to ensure we recruit the best possible candidates (Art. 6 (1) (f) GDPR).

 

 

6. Third parties we may share your personal data with:

We may share your personal data with the following recipients:

  • Service Providers & Contractors: We use carefully selected third-party providers to help manage our application process. All contractors are instructed in writing, bound by our directions, and vetted for their technical and organizational security measures. Within the EEA, these engagements are governed by data processing agreements pursuant to Art. 28(3) GDPR.

  • Freenow Group & Affiliates: Your information is shared with entities within the Freenow Group and our parent company, Lyft Inc., for the recruitment purposes described above.

  • Referrers: If a current Freenow employee referred you, we may inform them of your application progress and the final outcome.

  • Legal & Regulatory Authorities: We may disclose your data to local labor authorities, courts, regulatory bodies, or law enforcement to comply with applicable laws, regulations, or legal processes.

International Data Transfers

In some cases, your personal information is transferred to and processed in countries outside of your residence, where data protection laws may differ. While we store our primary data within the EU/EEA and UK, our global operations (including Lyft Inc. and various partners) require international transfers.

Whenever data is processed outside the EU/EEA, Freenow ensures a high level of protection by relying on:

  • Adequacy Decisions by the EU Commission (Art. 45 GDPR); or

  • Standard Contractual Clauses (SCCs) and Binding Corporate Rules (BCRs).

Freenow takes all necessary measures to ensure your data remains secure and private, regardless of where it is processed.

7. Your Rights:

You have the right to obtain confirmation as to whether or not personal data concerning you is being processed by us. Where this is the case, we will be pleased to give you access to the personal data and the information listed in Art. 15 GDPR. 

In addition, you have the right to rectification (Art. 16 GDPR), the right to erasure (Art. 17 GDPR), the right to restriction of processing (Art. 18 GDPR) and the right to data portability (Art. 20 GDPR), subject to the relevant legal requirements. In addition, you have the right to object to the processing under the statutory conditions (Art. 21 GDPR) or to withdraw any consent you have given at any time with effect for the future (Art. 7 (3) GDPR).

In order to assert your rights against us, it is sufficient to send an email to privacy@free-now.com or a postal letter to the address mentioned under “1. Information on the Data Controllers”. 

In addition, you may at any time lodge a complaint with a competent supervisory authority if you consider that the processing of your personal data infringes data protection regulations (Art. 77 GDPR).

8. Data Security:

We have taken appropriate technical and organisational measures to guarantee data security, in particular to protect your personal data against access by third parties, as well as accidental or intentional modification, loss or destruction. Such measures are reviewed periodically and adapted in line with the state of the art. 

9. Retention periods:

If you apply for a job at Freenow and your application is unsuccessful (or you withdraw from the process or decline our offer), we will retain your information for a period of up to 6 months after your application. We retain this information for various reasons, including in case we face a legal challenge in respect of a recruitment decision, to consider you for other current or future jobs and to help us better understand, analyse and improve our recruitment processes.

If you do not want us to retain your information for consideration for other roles, or want us to update it, please contact privacy@free-now.com. 

Please note, however, that we may retain some information if required by law or as necessary to protect ourselves from legal claimsIf we enter a relationship of employment with you, your data will be processed by the means set forth in the privacy policy for employees available on the internal Freenow Confluence page.

10. Updates and Changes:

We retain the right to modify this privacy policy at any time in the future in accordance with the applicable data protection regulations.
